I work with a colleague going through something similar... has a Tribunal case due soon... business have asked for countless ATOS reports... there has been falsifying of Attendance Procedure notes... seems they are trying to wear you down... hoping you'll jack the job in one way or the other... its deplorable...

I just had my Atos phone call, it was different from the other phone interviews I've had, it was a line of yes or no health questions, she then said I was been referred for a further medical with regards IHR, can RM force IHR on me for IBS?

I know one person whose atos referral stated that the condition would not improve until after surgery scheduled for six months later.
Within the intervening months there were six separate referrals to atos about the same issue. (Three within one month).
Even atos were getting fed up.
Management seem to only accept atos statements when it suits them.

IBS may rule you out of delivery but it shouldn't rule you out of other roles, possibly at other locations.

In my opinion... RM will try to get shot of anybody who has what they deem too much time off sick... preferably through the Attendance Procedure so they don't have to pay out. Can they force IHR on to you? Don't know the answer to that... speak with the union and maybe Disability Rights Commission to see where you stand.

Ultimately if they want you out it could well come to that. However, by doing so the business may leave themselves open to an ET claim by yourself which may well include your reinstatement...

I took your advice, Acas conciliation service is going to contact management at my office to try to resolve this, before I take it to ET

If management do the right thing I wont need to go to a ET but I've tried everything and got nowhere .
In short, I've been discriminated against, and I am covered under the equality act

There is a lot more emphasis on reconciliation prior to a claim being put forward... sounds like things are moving forward quickly... hope the outcome is positive for you...

Heard through the grapevine that there going to be pow-wow at a high level re RM managers allegedly misusing ATOS... ignoring reports when it suits etc... goes quite high up apparently... hope they get what's coming to them... :cuppa

Now don't be silly, it comes down from right at the top, hence why all managers get protected.

Why you are still employed by RM an ET won't deal with this, quite a few people mention filing a case but they don't understand what an ET actually will deal with.

I understand there is a joint meeting between the union and RM at quite a high level... what exactly its remit is I don't know... but the union are highlighting the misuse of ATOS within the framework of the meeting... there has been some shenanigans going on on my patch... one senior manager in particular allegedly...

I'm sure these meetings go on all the time... what the outcome is is anyone's guess...
