As time is against you the first priority is to have the meeting postponed. You stated that you also work for RM is it at the same office as your partner then you can enquire who is the union rep for this branch.

I thought if they precautionary suspend someone they always take their ID off them and advise them that they may not enter RM premises.

no he went in as a Christmas temp, then they asked him to go for an interview for the post position. he started that on the 4th January

exactly 6 months today being a posty

but I assume is contract start date would be the December one, not January

plus he also had his review and contract was extended to September.

Yes that is correct but precautionary suspension was never mentioned in "chrisintec" posting.

Exert from National Conduct Code Agreement:
Criminal actions outside employment should not be treated as automatic reasons for dismissal.
Employees should not be dismissed solely because a criminal charge against them is pending or because they are absent through having been remanded in custody.

In your original posting you stated "resign" " conduct" " failed triaist meeting" and as your partners ID has been removed and as mentioned by " motherhubbard" has your partner been precautionary suspended which you failed to mention. Is the meeting a " failed trialist" or a disciplinary meeting. If your partner suddenly realises that this meeting is in fact a disciplinary meeting and he has not signed any documents waiving his right to be accompanied then he should ask for the meeting to be postponed until he can contact the branch union rep to be represented.

they never mentioned anything about suspension.

once he went into work on Saturday to explain the situation of being arrested he was given the 2 options 'resign' or 'code of conduct'

he arrived in work yesterday and they changed it to a ' failed trialist meeting' ... so he received a letter yesterday asking him to attend today at 9am.

ive informed him that they haven't given him enough time to prepare and to get it postponed until a union rep can attend with him.

they took his id badge on Saturday , but no mention of suspension at all

the letter he received included a few sickness days, and on the back it says ' I will/ will not be attending ... I will/ will not be bringing a representative.

again as the letter was only received yesterday he couldn't sign and send back. he has taken it with him today unsigned until he knows if it can be postponed

he has just went in and asked for it to be postponed. manager said no and if he doesn't attend the meeting he will be sacked on the spot !!

how can they do this!

An employee on a probationary period has the majority of the same employment rights as a permanent employee one of them being the right to accompaniment at meeting where dismissal may be considered. Hope your partner at todays meeting has crossed on the letter that I will be represented. The interviewer then would have asked where is your representation and the reply should have been due to the time available have not been able to contact my representative and the meeting should have been postponed.

the meeting was postponed to yesterday.

my partner got sacked!

this whole meeting was to do with dishonesty regarding being at court. his manager changed it to say he has been sacked due to having 3 sick days.

even tho he had his review meeting 4 weeks ago and his contract was extended to September even with him having the 3 sick days then.

safe to say royal mail managers are sneaky and so unprofessional! raging is not even the word to cover it

Manager changed it because probably on advice from hr they realized they didn't have leg to stand on. As you say, very sneaky. What has the rep said about all of this?

the rep turned up at 7am and never told my partner hat time he would be there. the manager also never gave a time for the new meeting

funny thing is. today he also received his 6 month pay increment letter with contract. obviously a mistake

sorry to hear this news christinec it seems that the initial reason for this meeting was changed at the last minute. The letter your partner received and the content of this letter would have been to invite him to the meeting to answer the charges which was originally for not advising RM of his court appearance but this has now turned out to be concerning his 3 day sick absence and because of the sudden change I am assuming that a refurbished letter giving the reason for the meeting has not been sent to your partner. I am unsure if the branch union rep actually attended this meeting with your partner. You need to collate all the paperwork that your partner has received including the extended contract from HR and seek advice from a solicitor in employment law working on a no win/no fee basis. There may be a slim possibility that the dismissal may be in the list of AUTOMATIC DISMISSAL where the 2 years employment service is not required.

no the union rep turned up at 7am. the line manager never stated a time for the new meeting so my partner turned up at 9am. same time as original meeting. the line manager has added things into the meeting letter that seem to be very coincidental ie parcels going missing. leaving mail in the tray ect. things that wernt brought up at the 6 month review meeting.

I have written an appeal letter which will be sent today.

will also seek advice from CAB and ACAS and see how we get on
