They already have reported it, they rang their Manager, it says so in the first post of this Topic!

...it doesn't matter how you try to word it, Royal Mails requirement of within 24 hours unless a non-service day follows is only an internal Management request, not a madatory, MUST, rule for injured employees.

Bloody stupid rules - the dog bit you, it's an accident and get it reported - next they'll be saying you put your hand through the letterbox of the door where the dog lives so therefore - you approached it.

a near miss is something that could have resulted in an accident or injury, ie a york falling off the tail lift but not hitting anyone

There seems to be a lot of confusion over the term incident! An accident is a type of incident and a near miss is a type of incident.

The difference being that an accident results in an injury or damage whereas a near miss had the potential to cause injury or damage but didn't.

Thr interpretation as to the Health and Safety Executive is that:

An accident is an unforseen event that results in either bodily injury/damage to property, or both
An incident is an event that has the possibility to cause injury or damage to property.

I am not employed by Royal Mail but i am conversant in Health and Safety legislation.

From what i can see, Royal Mail are reluctant to record any form of accident or injury as it will have a direct affect on performance targets etc.

Royal Mail like any other company has a legal obligation for the welfare of its staff. Accident and incident reporting is a legal requirement so that preventative measures can be put into place to minimise any future possibility of injury.

With a major employer supported by a Trade Union, why is the statutory measure as to Employee Health and Safety being abused with no accountability.. Why is Royal Mail not being prosecuted for these breaches?

One of the main reasons is lack of training by the trade union, Local Safety Reps are given little or no training whatsoever, so do not really understand their role or responsibilities, though some do take it seriously and are good reps but are in the minority

Above the local reps at area level, the Area Safety reps and Area Reps are all usually on full time release from duties, so are on a nice sweet number with agreement from area managers so are very unmotivated to rock the boat and raise safety issues and are very much "in the pocket"

a recent improvement by Royal Mail at director level was to implement an email address to the head office where staff can email direct to "moya's" office this goes over and above area level and usually results in the safety issue being fixed rather quickly as it should

at director level they want to reduce accidents correctly but it as you come down the chain they are trying to hide the true figures to make it look like they are doing their job

The ultimate responsibility for employee Health and Safety is with the employer, not a Trade Union.
Why then is the employer being allowed to circumvent statutory provision simply because of corporate sensitivy, performance targets, or commercial obligations with impunity and no accountability.

It was direct at the trade union but only because you mentioned them,

the reason is simple, no one is look at it, there are no large HSE investigations into the company, HSE appear satisfied by RMs compliance, this is probably because no one is reporting them to the HSE and everything looks fine on paper

Why is the Trade Union not taking the issue of accountability up directly with the HSE considering the size of the employer?

The reason is that the higher up members in the union and RM do not realise there is much of a problem as the area safety reps do not report issues due the fact they are on full time release from duties (ie don't need to do their RM work and still get paid) at the grace of the area managers

It's the same with work place bullying by managers

I thank you for your comments as i am really trying to get My head around this.

We have a total failure of statutory obligation on the welfare of employees and members of the public. Royal Mail and the Trade Union just apply lip service and a bare minimum on Health and Safety to the detriment of others. Royal Mail and the Trade Union are allowed to get away with this practice as neither wishes to "rock the boat" due to a you scratch my back mentality.

Is that correct??

sort of correct but not the full picture, Nationally Royal Mail and the Trade union at senior level are wanting to correctly reduce accidents and make the work place safer, Nationally things are the way the should be, at area level managers just want their figures to look ok and dont care as long as they are below their accident targets,

the issue is at area level intentionally not reporting issues up the chain of command both within the union and Royal Mail

Heres a few practice currently going on in my local mail centre, Fire Routes blocked by yorks, PPE not being worn, HGV driversd working in non driving duties in excess of their driving hours limitation. That last one includes a saftey rep working over his legal driving hours on van collections

They get away with it as who is going to report them? t
