In the real "real" world, I would kick up stink from day 1 - and certainly would not advise waiting 8 and 10 weeks for due payment. It won't leave you much time to qualify for an ET (although not sure if you can) if you wanted to go down that route.

Unfortunately in a small company without a decent union to back you up employee rights are virtually non existent, you are faced with two choices 1) leave and hope to claim your money via the courts, that would be a complete waste of time or 2) Stick with it and try to make it either work or wait for redundancy and the government to pay your lost wages, up to 8 weeks capped at £380 then taxed and NI.

There's a big difference between things going wrong on a temporary basis and a company/a*sehole not paying his staff because he's a thieving btard.

If i dont get paid i too will kick up a stink instantly,Times are not easy and i have 2 kids to feed and a mortgage to pay,Like most people.


At this moment in time i bank on my wages being paid on time EVERY week,I sympathise with the guy,Stating get in the real world is ridiculous,So he is only to complain if he has no wage for 8 weeks?

tell me please, why is it a waste of time claming in the small claims court

i do not know where the £380 statutory redundency pay comes from, it is £430 maximun and is subject to your age and how many years service, not capped at 8 weeks

If the employer is declared insolvent or cannot pay your statutory redundancy pay, you can apply for a direct payment from the National Insurance Fund. To do this you must first write to your employer asking for your statutory redundancy pay

The Redundancy Payments Offices (RPOs) assess and pay statutory entitlements to redundancy and associated payments when an employer cannot or will not pay its employees.

i would submit a grievance, if the wages are not inn your next payday with arrears i would submit a claim with the employment tribunal service for unlawful deduction of wages

you do not wait eight weeks to claim through the employment service, i would put inn a claim after the 7 day grievance has expired. their is no employment length to consider with making a claim to the employment tribunal in a wages dispute

For the record guys still not paid those wages. Paid this weeks but as far as RM is concerned their comps don't make mistakes so I'm on the ham. Shown them my bank statements etc so I'll be taking to small claims or similar.

how did you inform royal mail about the loss of wages

was it by grievance, letter, email

you need to do this under the civil procedure rules, it is called pre action protocol

So far just been by phone call, not really sure what the proper procedure is now tbh. Never thought RM would screw me THIS way lol

you need top do a formal letter to your DOM

DO YOU HAVE A REP IN YOUR OFFICE AND WHY IS HE NOT DEALING WITH THIS

Lol can I guess ur in an office in the lothians ;)

some of the reps are amazing, ours isn't and I've stood up for myself for years so I have no faith in the union locally. There are offices with tremendous reps.

i am a southern softy rep, though management think different

their are branch elections on at the moment, if not to late please put your name forward

we all had to start someware

put your complaint about non payment of wages in a letter and head it FORMAL GRIEVANCE and give it to your dom

tell him you want the money in your wages within 7 days or you will be making a claim through the employment tribunal service under section 13 of the employment rights act unlawful deduction of wages
