That's not the question though.
The question is...is someone who intends to make full use of their annual leave entitled to ask for it back?
The system in place to refund annual leave when you are sick is designed to protect those that are unfit to take their annual leave not to provide an extra bonus 3 weeks when they come back with a sun tan.
By all means sit on the beach in Thailand...but should you be picking up sick pay for doing it?

You're absolutely right. I would arrange an ATOS assessment during his beach time and then nail his ass when he wasn't available. :cuppa
