Your DOM would need to find a nearby office with the capacity to take your full-time staff, so although your scenario is there to try to over emphasise your point, it'll never be a reality. Your local Rep should be working to find a compromise with the Manager on how best to staff the duties in the office using its available manpower and working hours. You do need to understand one thing however, seniority is not being overruled. The law does not accept that a company can base all of its decisions regarding their staff on their seniority level. Do you honestly think that an incapable colleague should always receive preference over a capable one who started on the same day as them but who is younger. Seniority can be used for things such as preference over duty selection from a set of similar skilled duties, but not for these sort of things.
