Well done! i'm on a pt contract and am looking forward to this being blown wide open. All part timers should get an average of their hours for sick and hols as other firms pay as is the law of UK except RM who are exempt. But well done to you.

Well done ,Pity you had no union suppourt ,always thought these 1 hour a week contracts were iffy.
Not seen many of them in our office recently ,the favourite is a Saturday only contract,just like the 1hr a week contract except a little holiday I think.MOst of our Saturday guys
all week at least 4hrs a week,far reaching implications of this tribuanal not just for RM BUT OTHER EMPLOYERS.

Funny how with a Socialist Goverement workers rights have been eroded to the bone.
I wonder if be any comment from the Union.

Pleased about that as I don't think we should be punished for having one hour contract and getting rest on overtime. I hope you will be able to get other 33 (if you work 34) hours every week for sick leave and floating week and holiday pay and bonus backdated.

Thank you whitemoor66 - that is very heartening and you must feel justly proud.
I have contacted my local MP to raise the issue in the House of Commons. I do hope that I can use your tribunal findings as evidence.

I still love my job (outside the depot) but the lack of paid annual leave, unpaid public holidays and scrapping around doing other lads door to doors etc has been a real financial strain. Waiting for the phone to ring at 6am to find out if I have any work for the day, even just 4 hours, is so demeaning.

Royal Mail has taken away alot of my dignity and self esteem - your tribunal result is at last some very good news.

Like the others, would like to see details of the ET ruling. If it sets a legal
precedent it will mean RM's plans for a part time disposable workforce without
rights to decent sickness/annual leave and pensions are dead in the water.
And best wishes to you in whatever you're doing now. Hope they treat you better
than RM.

Add: Wouldn't be at all surprised if RM takes it to Appeal though.

This is an interesting one , because in the 90's Major years , MacDonalds were took to court and zero hour contracts were outlawed , they were sending staff home when they were slack and their staff ended up on £1 something an hour .

Supermarkets had a habit of not paying overtime but giving staff time off in lieu instead .

I agree that RM could take it to appeal , if they sent for the cavalry in the shape of Eversheds to protect their managers , the orders must come from on very high . Never known such a paranoid firm & culture that operates in a permanent panic mode .

Never mind siege mentality management more like Hitler & Co in that " Downfall " film - no wonder they ask people what they've got against the BNP .

In some areas, RM are offering time off, instead of overtime payments. It's rather appropriately, called TOIL. Although, it's optional, for those who want more leave.

I have as well, but the problem is you need input from both sides and fairness in its implementation. If Royal Mail say you are to take toil instead of being paid OT then that does not quite meet the fairness or "input from both sides".

Also without an agreement and or rules in writing so that both sides know the exact circumstances when and if it should be applied it should not be used. To date I know of no national or even local arrangement that has been agreed the CWU.
