Well i'm off sick again now and I really dont know what to do. I had an accident last november in the callers, the gas boxes were piled high with part returns from the shift before me and as the boxes are only supposed to be 20-23kg? I started to distribute the parts between a couple more boxes. Picked up a smallish box with a gas part in (unlabelled I might add), as I did a huge hunk of metal ripped through the bottom of the box and I instinctively caught it incase it fell on my feet and jolted my back (nothing to do with my handling technique).That was on a friday evening, saturday I was in pain, sunday my back gave way and I couldnt sit, stand, roll over, nothing, couldn't move out of bed for 2 weeks had to call out the doctor. I struggled back to work when I could just about walk because my shift manager had already been hounding me about my asthma and sending me 4 page long essays about how they thought I should only have Asthma in the summer when its hot when she knows absolutely nothing about my DDA condition I have had all my life. If you were DDA with a missing limb you dont just have a missing limb when its hot do you? I was scared I would lose my job having just got off a S3. I have carried on with chronic low backpain and an undiagnosed slipped disc for a year until now because I now have no choice but to be off work. I have hadthe disabling chronic severe back pain and sciatica now for about 22 weeks and can barely walk most days, I cant even put my shoes on for myself. The only time I leave the house is to go to the doctors, or Tescos to pick my prescriptions and some food but always with my fiance and my father as I cannot walk for very long or carry anything substantial. The best bit is, my shift manager called me in for a meeting again and accused me to my face of skiving because someone had seen me in Tescos taking a sachet of hot chocolate off a shelf. This was even after she had reported me to Atos again and they had told her I am unfit for work. She seemed annoyed that they said I was unfit again, and at the time I was waiting for my MRI results. I have had the results and i'm now being reffered to a surgeon in birmingham for spinal surgery :cry which is usually a last resort but I wont have any quality of life if I stay as I am. My union rep probably thinks im nuts, I phoned my union rep crying when I was told I need surgery, I just broke down. I cant take it anymore, constant letters asking me to come to meetings and accusations that im faking. Im now very paranoid, deppressed and anxious. The other problem is that when I returned to work after the accident a year ago I was told it was too late to put it in the accident book and that I couldn't tick the yes *was it an accident on duty? yes? no?* on the return to work form. I didnt kick up a fuss at the time because I thought my back would heal and my manager was sympathetic about it, but its gotten worse and now I need surgery. If it was in the accident book it would have to be discounted, but seeing as it isnt, I dont have any protection do I?

Sorry this is really long, lost and upset, any advice would be greatly appreciated :wave

:nana If you go through thr D.S.S. they say accidents can be recorded inretrospect. (up to three years)
that is what i was told when R.M. tried the same thing on me---in my case they hadn't recorded my accident--
when I went back with that info, they couldn't argue---if you verbally reported it at the time, it should be enough.
I remember the D.SS saying in some cases they could actually go back ten years, and make Managers record accidents
that far back.
good Luck---just remind them they have a LEGAL duty to record these things,

It's always the same - women managers being even worse , must be some sort of competition with the blokes and it would be interesting to see who she is trying to impress .
Those so called bullying " managers " have broken every rule in the book , willful misrepresentation , malicious prosecution , Harassment Act 97 to cause distress , alarm etc , unfair detriment on H&S concerns .

Initially that sort are just being very petty BUT it's the way they try and save face .

Any Barrister from the CRE in a ET would eat those jumped up floor supervisors for breakfast - even ATOS won't do their dirty work. Heresay from a local gossip would be laughed out of any Tribunal .

That's a serious H&B CASE , you were badly advised , they've no interest in H&S , just keeping the HSE off their backs .
Call their bluff , why are they trying to bully you out of something or what are they frightened of you doing - do what they don't want you to do .
They are only interested in covering their sorry a***s - they are in a hole and are trying to dig their way out of it - badly ! - let that stupid woman hang herself !

Contact your rep soonest and ask him to come and see you as and when he can and submit a grievance for Bullying and Harrasment. He should then arrange a meeting with you, or possible he will contact the H&S Area Rep and they will get things kicked off. You will probably get help from the Union solicitors as well.

This is a good time to make the move as the Union have just asked for details of B&H cases so they will be keen to get involved in your plight by the looks of it.
