Temorary Contracts
Royal Mail & The CWU recognise and agree that there must be a consistent and equitable approach on the employment of all specific event and time contracts.

The key principle covering all aspects of temporary employment are as follows :

Royal Mail Group employees will be employed on substansive contracts except where there is genuine short term need identified.CWU will be consulted in advance where there is any such requirement.
Where such need is identified specific event and time contracts may be issues for more or less then 12 months with the period of the event being a determining factor.Such contracts will not exceed 2 years unless it has been jointly agreed that there are very exceptional circumstances.

The joint commitment will be to reduce temporary contracts by effective resource planning and joint co-operation in securing operational change covered by national agreements to the required timescales.Individual business units/recovery programmes will agree with CWU how they plan to substantiate temporary employess, giving priority to those with more then 2 years service and reviewing progress with the CWU on a regualar basis.

Following the comletion of major change of the major change programmes all remaining temporary contract staff within the resourcing area will be offered substansive contracts where vacancies exist.

Although you may say "well we haven't had major change yet".Well this agreement was updated in 2009,plus the CWU were not consulted. The legality is 4 years but the AGREED document is 2years.
Can someone give me a download link for this please, I couldn't find it, if its that one in the downloads section that takes me to the CWU site , I am not registered and don't know my membership number or how to get it. If someone could give me a download link please PM me.
Cheers

Have asked in the thread for someone to put the actual docs up.

It's good to get these types of threads, the ridiculous my manager said bollox, so we can reassure ourselves that while the world is falling apart, Royal Mail managers are still being the low-life C***S they have always been.
My BFF Clash
The daily grind of having to argue your case with an intellectual pigmy of a line manager is physically and emotionally draining.

They are victims of a loophole, now this wasn't the doms doing it was HR who have been going through contracts to see who they can get rid off. This isn't hear say this actually happend at my office and our DOM said HR will be looking at doing this to all offices, they wasn't even going to get told till they got a letter tomorrow but the DOM felt it was only right to tell them face to face.

So be warned if you are a full timer with less than 4 years service they are gunning for you.

I have a question for the union reps who were on here defending the agreement, i heared a few of you say removing the door to door payments will protect jobs, well its been a couple of months and now this. Where are you now, please reply as now we all know that jobs are never protected and no agreement will ever do that because royal mail do what they like. If none of you who defended it respond to my question about jobs protection I will dig through old posts and start quoting you.
Any dismissals that are made solely on the grounds of avoiding a fixed-term employee acquiring permanent status are likely to be unfair and in breach of the regulations. A decision not to renew a fixed-term contract is expressly regarded in law as a dismissal.

Fixed-term staff with more than a year's service are entitled not to be unfairly dismissed. Whatever their length of service, fixed-term employees can bring claims in relation to any treatment that is less favourable than that offered to comparable permanent employees (unless that treatment can be objectively justified).

Fixed-term rethink likely after landmark ruling

Public sector employers may be forced to rethink the use of popular fixed-term contracts after a tribunal ordered the Department for Education and Skills (DfES) to offer redundancy payments equal to those given to permanent staff.

The landmark tribunal hearing ruled that four education advisers on fixed-term contracts should be treated in the same way as permanent colleagues when redundancy payments are calculated.

The DfES must now either retain the claimants on permanent contracts when their current employment ends in 2006, or provide redundancy payments in line with the Civil Service Compensation Scheme.

Charles Howard, a partner at Russell Jones & Walker, represented the workers and said the ruling could have huge implications for the Civil Service.

"This case serves as a warning to employers that discriminating against fixed-term employees can have a very heavy financial cost," he said.
Paul Quain, a member of the management committee at the Employment Lawyers Association said the ruling had implications for all employers.

"It highlights the fact that employers need to consider all workers, not just permanent staff. Employers need to remember that the law sees no difference between the various categories of employee," he explained.

"Because fixed-term contracts are widely used across the country we could see many more cases, as this also applies to the private sector and charities," Quain added.

And whilst everyone elses health continues to nosedive due to the utterly Dickensian working patterns they want to force on us, the RM/CWU management team will continue to award themselves outrageous pay/bonus packages, as well as, very generous severance packages for when anyone of the w*****s decide to jump ship. :evil/mad

Boy! Am I glad I spent many and many a morning on a picket line over the years!!!! :evil/mad
