Break in service and seniority

Post by vinny79 »

Hoping someone will know

If I have a break in service due to resigning from the business for under 12 months

Upon my re employment do I keep my seniority or do I only keep my seniority in terms of total service for holiday entitlement etc?

I had heard under 12 months between leaving and returning means I keep seniority

Thank you

No unfortunately you don't.
Any break in service resets seniority.

Holiday entitlement is based on total service so you will keep that at least.

It may depend on why you resigned.

I done 10 years service.Left, then returned 2 years later.Done another 10 years so far.Do I get 20 year holiday entitlement or does that reset because of the length of break.

You get the 20 year entitlement as as all previous service counts, but only with annual leave allocation

Only the current leave year entitlement, but 18 months if you were long term sick within that year

But no harm in asking, they might agree with you.

It is all contained within the Way Forward agreement 2000 entitlement with annual leave and service length

So if I see my union rep ,next year's leave entitlement should be for a 20 year man.Is that right?

I have known 3 people in this exact situation and they all got all their outstanding leave back.
This is RMs fault. Why should the postie suffer because of it.

Nothing stopping the employer giving back any past missed entitlement, only there is no legal obligation for them to do so after that leave year has expired

I suggest the OP contacts HR and explains the situation.
His COM will be left in the crap and will offer as little as possible.
HR don't care and will do what is right.
