Section 44 Employment rights act 1996.
Section 44. provides employees with the means to contest the adequacy and/or suitability of safety arrangements without fear of recriminations (e.g. getting sacked or transferred) or suffering detriment (e.g. loss of wages).
Section 44. provides employees with the ‘right’ to withdraw from and to refuse to return to a workplace that is unsafe.
Employees are entitled to remain away from the workplace (e.g. stay at home) if – in their opinion – the prevailing circumstances represent a real risk of serious and imminent danger which they could not be expected to avert.

The CWU have consistently informed members that "if you feel your wirkplace is unsafe we will support you".
Misinformation on your part and you've misspelt the word "there"....should read "their" !
The substance of your post is of course correct (and has been law since 1996) That you weren't aware of this is no fault of your Union. If you feel your workplace is unsafe why on earth would you continue to go in everyday and work ??? Stay away...and fight your corner when the time is right ???

I have listened to many of the communications that the union has put out since the beginning of this,
To the unions credit, they have stated plenty of times that if you feel unsafe, nobody expects nor can force you to work and will back up anyone who feels unsafe and chooses not to work at this time.
It has also been stated many times on this forum, I know this because I myself have read it and written it.
Many people accuse the union of not being able to be all things to all people, It is very easy for people to say the union isn't doing enough, that the union isn't acting.
but people seem to forget that as a member of the union, you too are part of the union, you too need to act.
If you are unsafe at work and choose to continue on for the sake of the money rather than your safety but then bemoan the union for non action then thats the kind of person that is eroding the power that the union has, If people arn't willing to work in the interest of everyone, Royal mail isn't going to change the situation because they know they can continue to get away with it.

Where are the Health and Safety reps when you need them, they should have the authority to asses an office and close if not safe, I cannot believe for one minute every employee is keeping the 2 metre rule that the government have implemented.

I would say we are not in a position not to avert being two metres apart of course not having gloves and masks could be in the opinion of a worker put them at risk but as we are not being told to wear masks and gloves just to wash hands and stay two metres apart it would be hard to argue the case for walking out, a co worker with a cough fever would be good reason not to work and that would be my main concern. The union tell us not to start early take our breaks dont use cars on delivery abide by the rules and not to work if bad practice is happening that makes you feel unsafe, not much more they can do if most of what they say is ignored to get home early. I would agree that Health and Safety should be checking the offices out to stop bad practice.

Rm dosent give a toss since privitisation , profit is way more important than staffs health . Why would you even put any staffs lives at risk esp the next cpl weeks while the peak of this disease rises. Its not just ,,(if we dont feel safe then) ,, we should NOT be in at all . Not heard anything from this Rico guy which is really digusting and sums this guy up.
