Overtime while on leave

Post by sylwana811 »

Hi,
I’m on 35 hrs contract now, but from the beginning of signing this contract ( 6 months), I’m doing 38.
On the weekly payslip these extra 3 hrs comes up as SSPR.
Should I being paid these extra 3 hrs when on leave, if so, will 3 hrs come up on payslip as SSPR, as well?

Thank you for all your answers

Thanks.
Any links, etc, which can confirm that? My manager just refused paying these 3 hrs while on leave and I would like to prepare to the conversation tomorrow.

If you are being paid SSPR you are not being paid Scheduled Attendance and you won't get it paid while on holiday.
You need to speak to your rep and find out why it isn't being paid as SA.
Your other option is to claim through ACAS and join the tribunal queue.

I thought SSPR is the rate paid for the overtime over contracted hrs and up to 38 hrs?
So I think it’s correct these 3 hrs on the payslip appears as SSPR, as my contract is 35 hrs??? I’m lost here

You are correct so you will not recieve those 3 hours while on leave.

as said, you do 3hrs overtime per week but not actually committed to doing it, therefore you won't get it when on leave
however you can fill in a grievance over "average pay whilst on annual leave" and eventually you should get it, think it's a 13 week average but only on your 1st 4 weeks leave
RM are relying on most people not bothering claiming hence they're onto a winner

Tried the diy lol but at that time never got anywhere as acas did not deal with people from ni. now they do but just like you say cant be bothered now as cwu in my opinion should have had this done an dusted.

they paused the process to allow meaningful talks on other issues last nov/dec
why they never started again once RM took the CWU to court i'll never know, but every passing week for those who hammered overtime in nov/dec and taken leave after "may lose" out, the CWU team still seem focused on twitter & facebook, why they can't ditch it and write to us i don't know?
as for NI law, i know it was a different process but not sure how

Incorrect I think.
It appears on the payslip as weekday sch att @ sspr (p)

The pay rate is the same but the SA is paid while on holiday.

CURRENT STATE OF EMPLOYMENT TRIBUNALS
EDIT;

England and Wales

Due to the sheer volume of Employment Tribunals that have been lodged in England and Wales (it is estimated that the current number is around 2,000) a request was made by the Tribunal to extend the stay on these claims until 1st March 2020.

Unionline has confirmed that the next stage in the process will be a preliminary hearing at the Bristol Employment Tribunal in March or April 2020 to identify the lead claimants to act as a representative sample of all claimants who have lodged claims. A full merits hearing will then take place where the legal merits of the lead claimants’ cases will be tested. We have also been advised that if the lead claimants are successful with their claims, it will mean that Royal Mail Group are not acting in accordance with their legal obligations and will be liable for the losses of those workers who have lodged claims.

In advance of this hearing and to ensure that we have a robust process in place to progress through each stage, the DGS(P) Department has arranged a meeting with the Legal Services Department and Richard Lozano (Unionline) on 11th February 2020 to agree next steps.
