If someone falls and breaks bones while on delivery could you claim against rm.

What are the circumstances? Lots of considerations. Property owners fault? Proper footwear worn? Weather conditions? Reading mail as you walked?

It was wet. Correct footwear worn. Wasn't reading mail. Tripped on the garden kerb and slipped onto moss in garden and broke my ankle.

Possibly claim against home owner , but you would have to prove they were negligent as to kerb or moss. Possible claim against RM if the owner was proved to be negligent before and kerb or moss had not been added to walk log as a trip/fall hazard. Get H&S rep to have a look and take photos , branch will advise what way to proceed.

As per "Correct" Footwear. I really don't see how RM could say the postie was at fault for wearing their own trainers instead of RM footwear when they must deem it perfectly safe as they allow people to wear other footwear with a Dr's note.

What difference to safety does it make with or without a Dr's note?

Other than that. Did you place yourself in unnecessary risk? Did you perform your own risk assessment or was it a hidden danger? You say garden kerb? Do you mean garden path slabs? If so, were the slabs visibly loose or raised? Or was it only when you stepped on them it shifted? If it was just a kerb then I think it's reasonable for one to navigate that safely with due care. As per the moss. Im not sure you have anything there as we shouldn't be on a customers grass in the first place and its reasonable to assume it would be slippery.

The was an overgrown Bush on the kerbing I fell off this and put my foot on the grass as support but then slipped and busted my ankle.
