Dear Colleagues,
Royal Mail Group Holiday Pay
Further to LTB 344/19 Branches will be aware that we have been in dialogue with ACAS concerning the Early Conciliation process and how this can be streamlined. Given that the number of claims is now increasing on a daily basis, any amendments that result in less time being needed for conversations between Branches and ACAS will no doubt be welcomed by both parties.
I am therefore pleased to inform Branches that we have now agreed the attached process with ACAS which will commence from Monday 24th June 2019.
Branches should also note that ACAS believe a collective resolution to the current impasse provides the best way forward and in light of this a meeting was held with Royal Mail Group on Tuesday 11th June 2019 with a further meeting date set for Friday 21st June 2019. We have made it clear to the Business that this matter cannot remain unresolved for much longer and that when we next meet they must submit a proposal for a National Collective Agreement.
At a national presentation on Wednesday 12th June 2019 regarding the future strategy of Royal Mail Group, Senior Managers stated their intention to reach a swift Agreement on the issue of average pay on leave. They must now put their words into action. In the absence of such an Agreement it is abundantly clear that this issue is gathering increased momentum among our members and that the number of Early Conciliation claims continue to multiply.
In closing I would like to reiterate that we continue to encourage every member to make a claim if they are not in receipt of their average pay whilst on annual leave and reconfirm that the Union is committed to achieving a National Collective Agreement that will meet our members’ aspirations.

Are we looking to back date this pay from March 2016. The Prison Service have set the precedent with their win in court (The Berryman case).

I have heard that documents have been submitted to change the law from 12 weeks average to a rolling 52 weeks average. This makes sense as it would take into account seasonal changes I.e. All the extra work and overtime worked prior to Christmas. It is aimed that the law will change and come into effect on the 1st April 2020.

You must claim within 3 months of taking the leave (but the longer you leave it, the greater the risk ofhero22 wrote:how far back can we claim for ? is it 3 months ?
your claim expiring if there's any admin/paperwork/communication delays).
The amount you can claim for is the average pay of the 12 weeks immediately prior to the leave period you are claiming for.
You can only claim for the first twenty days of leave taken.

has anybody filled the acas online one in as it asks for royal mails address but it also asks for a directors name so can anyone whos done one of these give me a bit of advice , thanks ,

While England and Wales are limited to back dating payments to 2016, in NI there is no legislation limiting the time period for back payments of holiday pay.This week the Police service won a case which allows back payments to go back to 1998.
As employees this is money we should have been paid all along and RM has known this but has choosen not to pay us.
Will the Union work to ensure staff in NI get the money owed to them over the last twenty years or settle for the two years that England and Wales are asked to settle for due to the Tory government rushing through legislation to prevent our colleagues getting their due payments?

I believe that reps were given an update today on holiday pay. Can anyone fill us in on the latest state of play?
Is it still worth going to the trouble of pursuing an individual claim or are RM and CWU close to some form of resolution?
