I returned to work this week after breaking my ankle whilst on delivery back in January (12 weeks off in total).
I was informed yesterday by my manager that I'd triggered a stage 1 and he'd have to go through the process of sending me the letter etc
Can it be issued ? He said if the accident is found to be my fault it can be issued, seems madness to me, not like I asked to break my ankle and be out of action for so long. I'm normally so active outside of work so its been my worst nightmare.
I've spoken to my office rep who seems to think it can be issued but he wants to check with the area reps.

dislocated my shoulder in November, came back to work in January and got a stage one warning.
it will get issued, even though it is the DOM's prerogative HR will tell them to issue it.
if you get to a stage 3 ( which I doubt you will ) you can then question why you were given a stage one warning for an accident at work.
6 months and you will be off the stage :)

they tend to give stage 1 if you trigger it no matter what the reason is (pretty much)
As all self certs are treated as genuine (before stage 3), then triggering a stage 1 by being over the limits with multiple instances of "flu" in a year is equal to being off with a broken ankle or dislocated shoulder.
The only time this changes is as doorstepped says, if you go to stage 3 and they review your sick record, they can the use their judgement over the "legitimacy" of your absences.
