I am trying to find something in black and white which answers this question. If postman A has picked a duty 6 months ago with a contract increase from 18 to 24 hours, when the vacant duties are advertised again now can he pick a duty with a contract increase to 30 hours.The DOM has said no quoting the Way forward agreement (having to remain in a duty for 12 months after picking it), but this means that Postman B with less senioity picks the 30 hour duty. I believe that the DOM is confusing duties with contracts (way forward) and the increase contract should go to the senior OPG, but I can't find anything to support this.

Yes is the simple answer. The 12 month rule is generally correct, but is not applicable when the postie concerned is increasing his contract hours.

My belief is the same, but the DOM on advice from HR is sticking with the 12 month rule ,I want to go back to them with an agreement or policy that backs me up.

It’s correct that your tied to a Duty for 12 months after signing for it. Wouldn’t seniority only come into it if it was making pt up to ft to cover indoor work? Not signing a Duty which requires more hours to deliver?

Correct. I'll rephrase. Op is entitled to apply for the duty in question. The DOM cannot use the way forward agreement to block the application, he is totally in the wrong.

The manager should not be stopping anyone increasing the hours/income regardless if the person in question has picked into a duty within the last 12 months, if it’s a duty that matches his current contract then the manager will have an argument.
