Manager refusing resign

Post by matthew68 »

We had our changes some six years ago now, the manager put me onto floating despite me being more senior to several people and he would not do a re-sign I asked union wrap but then he was retired and it never got done, eventually put me on a walk which I didn’t really want to go on when someone retired . It’s okay but there are at least two different walks which I want to go on I am senior to both of these people and that one person has left due to I’ll health he still won’t put me on this round and there is no proper reason why not .Can I insist on a re sign as I’m senior to lots of people that will have more choice or as the manager says it’s business needs do nothing about it which seems very unfair? What is the unions stance on this and can they insist on a re-sign as basically he seems to do what he wants with people?

Ok will try that but Dom seems to always get his way with duties and wandered if we can insist on resign as we’ve never had one?

I think a certain percentage of walks have to be significantly changed before a resign is enacted but I'm not sure what the percentage is. Resigns generally upset most staff in a DO so if they can be avoided they usually are.

If a resign is triggered due to major change it has nothing to do with management. The cwu implements and monitors the resign process however if your office has left it for six years you've pretty much accepted the status quo so it's unlikely at this late stage that you could argue for a full resign. Why it has been left so long is another matter.....

That aside any vacant duty should after no longer than 6 months be advertised in line with the way forward agreement.

Resigns are a major pain in the ringpiece for the reps and that is the reason why they're left so long, in the hope they'll just be forgotten about.

You can’t have someone moved from a Duty because your more senior to them. If someone retires then the duty should remain vacant for no more than 6 months before its advertised then everyone will have the chance to apply for it. You didn’t say when you signed for the current duty your on. It’s also worth noting that your tied to a Duty for a minimum of 12 months after signing for it, so anyone that’s signed for a Duty in the previous year will be unable to apply for the vacant duty. As others have said it takes a major change on a Duty for it to go into a resign, and if a Duty is unchanged then it’s only with the current duty holders permission that it would go into the resign pot.

we have never had a re-sign since I have been in fact no one has signed for any walk in the office the manager just allocate people who tend to stay on the same one I was put on this duty for just over a year ago because I was fed up floating but I have not signed for this duty and sometimes my manager still changes me now when it suits him. So I am asking as we have never Had a proper re-sign how does it work the manager says he doesn’t want to resign in fact no one is an actually signed for a walk anyway LOL. He just seems to allocate people when it suits him which is why am asking can I insist, I was actually having a proper re-sign at last

As Woody Guthrie says above, 6 years is a long time to make a case for a resign, however if there’s enough of you that feel the same way, then yous should get together with the office/local rep and make a case for filling the vacant duties in the office. If there’s no rep, then it’s up to the union members in the office to vote someone in. For reference, The Way Forward Agreement, under Way of Working is where you would make a start. However, if no one stands up and says anything about it, nothing will get done.

Good Luck
