Criminal conviction

What would be the likely outcome if some one working for Rm was given a short prison sentance say 4- 6 Months ( crime not work related )
Would he or she be sacked immediatly. go through some proccess, or no action taken return to work after finnishing prison sentance.

Are you suggesting that Crozier and/or Leighton are about to be sent down ?

I know one member of staff who took unpaid special leave before a prison sentence and then came back!

From past experience(not mine ) they would be sacked for bringing royal mail into disrepute.

Some one in my office was sent down for 6 months for assault (none work related) and came back to his job.

I suppose it depends what the conviction was for. I seriously doubt that they would allow someone who was convicted of Burgulary or Theft back, because there is a risk of them doing the same at work. There are some high value items which could easily fit in their pockets.

If on the other hand, it was Drunk and Disorderly, a Motoring Offence, etc., then I can't see what grounds they would have for sacking you, unless you were in uniform at the time. Or you drive RM vehicles and get a Driving Offence.

12 CRIMINAL ACTS OUTSIDE EMPLOYMENT
Criminal actions should not be treated as automatic reasons for charges or dismissal under the Code regardless of whether the offence has any relevance to the duties of the individual as an employee. The main considerations should be whether the offence is one that makes the individual unsuitable for his or her type of work or unacceptable to other employees or the business. The charge of bringing the business into disrepute may be appropriate but should not be automatic. Employees should not be dismissed solely because a criminal charge against them is pending or because they are absent through having been remanded in custody.
13 GROSS MISCONDUCT
Some types of behaviour are so serious and so unacceptable, if proved, as to warrant dismissal without notice (summary dismissal) or pay in lieu of notice. It is not possible to construct a definitive list of what constitutes gross misconduct, and in any event all cases will be dealt with on their merits. However, the following examples show some types of behaviour which in certain circumstances could be judged to be gross misconduct.
· Theft
· Violence
· Harassment and bullying
· Abusive behaviour to customers
· Wilful Delay of mail
· Deliberate disregard of health, safety and security procedures or instructions
· Unauthorised entry to computer records
· Criminal acts against the Post Office or its employees

GROSS MISCONDUCT... Well the reasons to be judged as causing this COULD be taken into account Dont leave much scope does it????

I do think we should be vettec better before the newbies are even given a trial.... ANYONE can get a job now... This in its self brings down the level of grade for posties and in turn gives us a bad name.....

Might explain why some people might go 'missing' for several months only to return out of the blue!
Would this go down in the signing in book as 'other absence' I wonder....
On a serious note I can think of a serious crime or two that has been committed and I wonder whether individuals concerned will eventually be let back into their old job! Well this is RM after all, anything is possible.

as long as the crime wasn,t fraud, say like stealing peoples pensions for example, i,m sure the culprit wouldn,t get sacked!! on the contrary, he would be very welcome to a job at RM........... mmm

Yeah but they won their tribunal cases and one got reinstated and the other took the money.
