Taken off duty

Post by Ciderboy1957 »

Removed from my duty yesterday .
Customer made complaint , re inappropriate behavior dating back to February 2018 , plus firm not answering intercom so I left P739s , not happy having to collect items at callers office .
Manager said he consulted with HR and they advised to remove from duty ,!
Union rep questioned but no success

Bullshit. You must have to be shown WHY you are being moved and it must be a good reason. Because some droid can't be added to walk to DO is not one. Or is DOM trying to get one of his runners onto the walk. He can spout all the crap about operational efficiency blah blah, but we all know this is b,s.

Innappropriate behaviour would have to be substaniated and dating back to February makes the complaint a farce. You made the decision to leave a P739 and the custoner could have requested a redelivery.
Accompanied by your rep you request your manager to produce in writing the advice from HR to remove you from your duty and copy you in.
You should also mention why you have been removed from your duty because of one customer on your round and there have been no other complaints from cutomers so why can't you continue on your walk and omit this customer.
Manager's action makes you the offender and in the interests of justice this has yet to be proved.

Taken off duty

Post by Anonymous100 »

I hope you don’t mind me commenting on this post but the reason I am here is because this also keeps happening to me.
Recently I’ve been given a shared van duty with another driver and so far I am yet to complete a full week on it, I had a huge row with the DOM when he took me off my duty because initially I didn’t think he was allowed to take me off my duty once I’ve signed for it.
After speaking to the union rep his told me that the DOM can take anybody off there walk if it’s for operational purposes and I am not allowed to refuse an reasonable instruction.

So this week, surprise surprise he takes me off again and makes me spare, his reason was that both myself and my partner are both drivers and he needs a driver.
My response to that is that in my office there are LOADS of duties with two drivers on them so why does he keep taking me off my walk and his not taking someone else off too so at least it’s done fairly.
Then what makes things even more of a pisstake is after finding out I was to be spare, they then discovered that there wasn’t a spare van for me, so I ended up going out with another driver doing peoples cut offs.

Which surely the non driver who went onto my duty today could have done and I could have stayed on my duty today!

My office needs a complete new management team because I honestly don’t think this lot have a clue what they are doing.
I just wanted to ask if anybody had any advice for me about what steps I could take if they keep taking me off more then once a week.
They said to me I can’t refuse a reasonable instruction, but surely if I have my own duty and they are taking me off it all the time that’s unreasonable isn’t it? Especially when they don’t seem to be taking anybody else off there duties.

In your signed duty which consists of two drivers which one of you is the nominated driver for the duty and responsible for van keys, van check and log book entries if it is the other person then your dom has every right to move you for operational needs as stated in your duty "318".
Specifically selecting you above others whose duty includes two drivers is an argument you can take up with your union rep and manager.
There is also the possibility that the other person in your signed duty has a viable reason for being committed to driving.
Having two drivers to a loop can also cover unforseen circumstances should a sudden illness take place.
Your rep is correct in stating that you cannot refuse a reasonable instuction it becomes unreasonable as previously stated if you are continually selected if others can perform the alternative duty that you have been removed to cover in the first place and the operation of the office is not effected in anyway.

why not play them at their own game,
use a trolley (i know yes) do a thorough van check every day if changing to a different van, spend time reading walk log for hazards, do not nest households and insert them a they should be, maybe even take your full break indoor, do not drive van once out on delivery if other has signed for it if they do get you mopping up until you also quick check on it and sign log book every switch,
it may upset your partner but i'm sure they'd understand, any grief about under performance ask for figures, they shouldn't be able to touch you, then go to doctors!
it would be an idea for you to inform your rep if you did even some of those, he may probably tell the dom and he's either going to target you more or back off,
either way it needs bringing to a head if it's getting you down
