Unrelated sick leave after maternity leave?

Unrelated sick leave after maternity leave?

Hi there,

I was due to have knee surgery before I fell pregnant (which my manager knows about) but due to being pregnant I was unable to have said surgery. I have now had my lovely little boy and have been placed back on the waiting list for my knee surgery.

My question is, how does sick leave/pay work following maternity leave? As the likelihood is, I will be off for 3 months with one knee then back for 3 months and off again for 3 months for the other knee.

Your leave of absence for your knee surgery should be treated separately from your maternity leave.
Taking that you are a postwoman with a walk and your manager is fully aware that sometime in the future you will be haviing CORRECTIVE surgery to restore your knees in order that you can continue with your duty on a full time basis then if manager has any degree of common sense then these absences should be discounted in the attendance procedure.
Your union rep would be arguing that your workload and your type of work has had an adverse effect and contributed to the condition of your knees that surgery is now inevitable.
I would be lodging a grievance if manager moves to a formal stage review prompt.

Thank you for your reply. I'm actually a collections driver, but I'm assuming that this shouldn't make a difference to returning to work after maternity then going onto sick leave?

My manager is fully aware of my circumstances. I just wasn't sure that I could go on sick leave immediately or not.

Do you know if the sick pay is also seperate? Or will I only qualify for statutory sick pay?

You need to have worked for RM for 1 year to receive sick pay. If you haven't you would be entitled to SSP. Don't be surprised if your Dom puts you on a stage 1. You can say your sickness is due to your work he might say prove it. This is happening to me at the moment with a serious back problem. I can't really prove my job caused the problem. Although it's bloody obvious to a normal person. But don't just accept what he says get the union involved. Best of luck with your op.

Doesn’t matter if the job caused the sickness or not. All sickness is to be treated as genuine as per the attendance policy

It's not whether the sickness is genuine, I'm talking about stages not whether genuine or not. If your job caused your sickness then they cannot put you on a stage 1 .

Are you referring to an accident on delivery? Yes that’s not counted towards the formal process.
Chances are the manager won’t care and will issue it. I’ve never heard of a manager deciding to not issue one.
Why’re used to bully and intimidate staff.
If anyone gets given a stage which is against the policy I say put in a grievance, then a stage 2 and out a 14 day deadline innit. Then talk to ACAS and go to early consiliation.

If it is your intention to go on sick leave following on from your maternity leave then you must inform your manager of your change in your absence conditions and have this sick leave covered by a GP fit note and set up maintaining contact details.
If your length of service is over 12 months then RM sick pay policy applies.
