hi
I have a 35 hour contract. ( was finally upgraded last summer as years of asking )


have asked about the contract many times but getting stalled

last week I only got 35 which im still to sort ( only found out in pay slip today )

but this week I've had to sign for the extra hour or so every day

I've been told if I don't work the overtime they will remove me from my round

union reps not given me a lot of help to be honest

hopefully someone on here can help to where I stand and my rights and what could happen if I make demands etc

This sounds like your DOM is crap. It’s either a 35hr duty or 39hr duty. Ask him which it is. If he says it’s a 35hr duty then ask him for a break down of the duty span. (Time on deliver, breaks, time on collection etc) if he gives you that and it is in fact a 39hr duty then push for a 39hr contract. Also overtime is optional not compulsory and it sounds like your DOM is trying to blackmail you. If you are not happy with your union rep phone the area rep.

I didn't think anyone was getting a new 39 hour contract given that full time will be 38 hours in a few months with the flight path to 35 on the way.

35 hours is the new full time.
The societies of consumption and squandering of material resources are incompatible with the idea of economic growth and a clean planet.

And this is still only may. Colchester and Guilford areas are currently advertising for full time, perm 39 hrs. They are even advertising them on the outside is not just for internal so they must be really cheap duties but one is a collection mon=for 11am/18:48. Exactly the same days and times of one of my day duties when I was in the job but home for about 5. Lovely. :cuppa :cuppa

It is in our new deal that anyone coming into the business or who is part time and are now getting a full time job will get a 35 hour contract. If the job in question takes 39 hours then you will need to book the overtime.

My point was to highlight the fact that up to October 2018 existing or new staff can still be taken on with 39 hour contract.
Then we have been told that in October the 39 hour week is reduced to 38.

I suppose you could argue if you are an existing colleague, as opposed "new", you could still attain a 38 hour full time contract from October.

People are getting confused here. If the duty has not been aligned to be doable in 35hrs and can only be done if the member of staff works 39hrs then if office budgets allow it that member of staff should be made up to 39hrs.

eg

with my contract being 35 hours ( 7 hours per day ) im having to sign for the extra hour or so every day

next bank holiday week they will not pay me the extra hour but expect me to do the whole 8 hours due to having had the Monday off :cry
Jesus this goes from bad to worse. I couldn’t be more clear, you get paid for ALL hours worked. Never ever work for FREE it really does sound like you need to contact to area rep asap.

what office are you at if you don't mind saying ?

I think I have to put a grievance in about my contract, maybe I could use your office as an example
