Hi in an attendance meeting I was told that national agreements are for advice only and aren't to be followed to the letter. Is this true or is there something I can show them that they are talking rubbish. Also I was off in November and had a stage 2 meeting but never heard anything else and have now gone off sick again - same condition-can the stage 2 be issued if I'm absent from work?

The national agreement is here, what exactly are they saying, they can't make it up as they go along, I guess a rep was there also yes?...

Yes the rep was there but he's new and learning. The stage 1 was triggered by an accident at work which triggered a stage 1 on its own and manager said was discounted as an accident at work, but following another absence a few months later was included to trigger the stage 1. The stage 2 and current absence have been triggered by a condition I have which I have had for 12 months +.i need surgery to correct it but the waiting times are horrendous and need tests first to show if the surgery can in fact correct it. Medication makes me ill but I have to take it to control the issue. Worrying about if I am going back to a stage 3 is making me worse as well.

Can I demand to be referred to oh assist or is it at a managers discretion?

Ok so can accident at work is normally discounted from the procedure so it shouldn’t have been issued.
Sounds like you’re covered under the equality act. See your gp, get them to write a note recommending that you are referred to occupational health. Ask your manager to refer you. Grievance if he doesn’t.
Talk to ACAS. THEY MUST MAKE ADJUSTMENTS ITS THE LAW
