Are the attendance reviews being
Implemented in all areas in the same Manner
As we are experiencing in EHMC.
At present we are sitting at 98% issue rate
For 1st/2nd reviews.
It doesnt matter if the equality act is involved
They just keep issuing .
We have raised this at national level and are
waiting on a response .
If you are in the same boat as us contact HQ.

Take it to the highest authority level by grievance until you get a satisfactory reply.

With my area we progress with the grievance. After 28 days we complete the acas early conciliation resolution form.
With equality act do the same and point out page 41. Does an employees disability count towards.
It confirms that the business would have to confirm in advance they are no longer discounting employees disability.

My stage 2 issued incorrectly. Union don’t car. Escalated to stage 2 grievance with HR, tht was 40 days ago.
Can’t take to acas as it’s gone past 3 months. So so bad.

I was given a stage warning for cancer, which is covered by the equality act. I had to write to justsayit to get it overturned.
More recently I have been given a stage warning for an accident at work, when I broke my ankle whilst on duty. Again, a stage warning should not have been issued, but I can't be bothered to argue any more.
I think the problem is that the local managers are pressurised into issuing the stages by the managers above them. Local managers aren't really managers, they have no power and just have to do what they are told.

HR told me stage 3 is just an appeal against stage 2, like it’s always been.
Stage 3 notification would be received if you incurred a further 2 absences or 10 days after receiving a stage2 but the stage 3 gives a right of appeal that a stage1 or stage2 does'nt.
But at the appeal stage of the stage 3 where dismissal is being considered the appeals manager will independantly review the stage 1 and stage 2 decisions and if this has been given incorrectly previously then the appeals manager can uphold, reduce or revoke the penalty.
