Advice on accident on delivery

Hi,

I'm looking for your thoughts and advice on an accident i had on delivery last February in similar conditions to what we have now. I slipped up on a path with a steep decent in the snow/ice and chipped the bone on my elbow which was bleeding badly and bashed the back of my head on the concrete pavement, it was at the end of the delivery on a SATURDAY. My park & loop partner called the office but all the managers had gone, i went to hospital where they assessed me with soft tissue damage and concussion, they advised to rest and recuperate. This i did and called in sick on the Monday (DOM was off), on the Tuesday the Dom called me and was really nice to me stating that the reporting of the accident had been a big 'cock up' his side and no report had been filed in time, it was the first he knew of it on the Tuesday. He said he'd taken a look at my next annual leave which was in 2 weeks time and suggested not to worry about reporting it and for me to stay off for the 2 weeks and then return if i was ok after my annual leave week. I asked if i would be down as being off sick and he stated i would just down as being 'somewhere'....

Anyway i returned after my annual leave until now doing the job as usual but i've been in constant pain in the areas where i fell, it is not stopping me from working but it is stopping me from sleeping and i have constant back/neck and head pain...what i would call chronic pain.

I keep feeling aggreaved at how it was dealt with but i now realise i should have pushed to get it reported, it was just the way it was put to me at the time by the DOM that made me not bother.

Is it worth pursuing this now 10 months on with a personal injury firm ? Or would i not have a leg to stand on with no ERICA being done?

I'm just feeling a bit conned maybe to cover stats/bonuses their side.

Best point of call is to speak to your CWU rep. If anything like this happens in the future you should always keep your rep informed as to what is going on. Alas you cannot trust most managers in Royal Mail to follow procedure.

Yes i did speak to our Rep and he kind of got on well with the DOM (he's gone now) so didn't voice an opinion....i don't feel my reps an avenue i can go down now.

You have a time limit of 3 years from the date of the accident for a personal injury claim.
It would be beneficial to you if you have some supportive evidence to assist your claim such as a record of your visit to GP.
Companies who specialise in this area will do the spade work on your behalf.

I am sure the CWU would be the ones to assist you on this matter and offer advice. I would ask your rep to give you the telephone number/email of CWU headquarters and take it from there.

When I started with RM years ago we were always told that we must report any accident or dog attack however small,and it was always followed up.What a difference it is now,even if you report any incident it is nearly always brushed under the carpet. Think it must effect the DOMs bonus.What an utter disgrace,and RM make out they care about the posties health and safety. It a joke

Yes i still have the grievance i put in as they didn't give any weather warning before we left the office and it had snowed overnight, with the grievance are pictures of the injuries along with pictures of my footwear and a supporting hospital report. The only thing i no longer have are the text messages i sent to the managers that day and the calls that none of them answered. One of the managers who was working that day did answer at 1:43pm but was on his way to the airport to go on holiday! Only at Royal Mail....

Got it in one. All to do with the DOM's bonus which is why they must not be allowed to brush it under the carpet.
