Yes I know it says “no right to appeal”
That doesn’t mean that there’s no right to putting in a grievance if warranted and even going to the tribunal stage?

correct. my wife put a grievance in against a stage warning that was issued when she had to have fetility treatment and they had to overturn it and remove it from her record.

It is very rare to have a formal stage review 1 decision overturned even with mitigating circumstances as the issuing manager believes that my putting you on the stage ladder this will be a reminder for the employee to do their best to avoid going to stage 2 and stage 3 levels where dismissal is considered.Creditshampoo wrote:Yes I know it says “no right to appeal”

The union wanted to have appeals at all stage levels but this was rejected by RM for the increased workload that would be put on them.
You will be aware that the appeals manager has the ability to uphold, reduce or revoke a dismissal decision and will view all the absences that have been calculated on reaching the stage 3 level and carefully consider if the decision to give a stage warning are merited in relation to the circumstances.
If a dismissal decision was upheld by the appeals manager then you have the right to continue to an ET.

Has anyone ever had a stage overturned?
personally I think its a disgrace that you cant appeal a stage. I was issued one years ago when I went sick with chest pains. it turned out I had atrial fibrillation and was hospitalised for a few days then off for ten days to rest. situations like this mean that you can be put on a stage through no fault of your own and the manager has made the wrong decision to issue it. but his wrong decision may as well be a right decision because you cant appeal. it puts you under unnecessary stress dealing with the worry you may go down with sickness again, thereby triggering a second stage causing more worry and so on etc. even rapists and murderers have the right to appeal a sentence, but not posties.

ALL sickness is treated as genuine though, thats the key point... at least until stage 3 when things like your circumstances would be reviewed and probably looked at more favourably than someone constantly off every few months with "minor" illness / excuses.daveyeff wrote:personally I think its a disgrace that you cant appeal a stage. they say it is but its obviously not. why would a stage be issued to someone with heart trouble. the same DOM issued one to a bloke who fell down a manhole and broke his collarbone, stating the postie should've been looking where he was going. (caring employer) they issue stages mechanistically and don't give a monkeys whether its genuine or not.

The process seems to me to be reasonably well-intentioned with regard to 'fairness' but pretty arbitrary, even nepotistic, in application.

In theory they should at least put a reason why but they always use the not up to standard as it covers all bases for them.

How long does each stage stay in place before you have a clean slate again?

Stage wiped every 6 months (so of your on a stage 2 after 6 months it drops to a stage 1 then another 6 minths later it's wiped clean as long as no more illnesses trigger a stage)49erman wrote:How long does each stage stay in place before you have a clean slate again?
