Medical Retirement

Anyone out there know how medical retirement works ? Some people seem to get medical retirement while others get the sack. I have a bad foot and back problems which are getting worse and I can't see me being able to deliver all the crap we have for much longer. Anyone help out there!

id advise you speak to the e.h.s and they in turn can inform royal mail of your problems, they will be able to recommend i.h.r if they think your problems warrant it. you realy should have been offered the chance to see them before it gets to this stage though

Are you a CWU member? If so .. speak to your rep .. who will point you towards your Area Health & Safety Rep! What is your sick record like? Have you got a sympathetic doctor? Any accidents on 'duty' .. causing your problems. Expand a bit .. old mate!

the ill health retirement agreement covers 2 types of retirement
lump sum and full pension

the most common retireement is with lump sum this has a medical criteria of basically
if you are incapable through illness or injury of performing your current duty or any duty
reasonably expected of you for the forseeable future
then you would qualify for lump sum
the foreseeable future is considered 9 months from date of medical opinion
this pays a lump sum and pilon dependant on basic pay allowances and length of service

full pension the criteria are
incapable of doing any job inside or outside the business for 10 years or until retirement
whichever is sooner

the agreement is quite long winded and you would need to speak to an area rep or a very clued up rep
as their is an addendum to the agreement and the ins and outs of the referral and notice periods are not
normal and they have to do a trawl for suitable vacancies in the agm area before the rtu

i havent quoted the agreement its just what i can remember of the top of my head

basically if you are likely to be on the sick or on rehab for 9 months then you would get lump sum

should have had a Business Referral Form , but it's not like RM to be underhand (not) and botch things as the light bulb has lit up in somebody's head and got excited .

The problem with those forms is they contain leading questions from SM's/DOM's and such like with desired Royal Mail answers . ATOS Origin are merely contractors and the golden rule is don't upset the cilent .
The ATOS Dr doesn't want to be cited in a ET or subject to a GMC complaint , so he/she's in a difficult position.

i have a feeling that i might be medically pensioned as i have nerve damage from my op which rm caused. i have been there 4 yrs and the neurosurgeon reckons it could be a yr b4 my nerves are healed. how long is the longest i can be on rehab for? and will they try and find something suitable indoors for me to do rather than pension me off
oh and im a part timer

what about DDA issues -there's medical problems affecting quality of life for more than a year , adjustments to be made . Wouldn't sound good in a ET talking about injuries and operations .
The problem is RM making things difficult to "manage " people out of the business. ATOS Origin don't do sympathy , they just want people through the door ASAP.

Thanks for the replies,I'll see my Rep this week as he's been away.Just to clarify things,I've been at RM 22 years and have a good sick record.My foot injury was on my walk in 1989 and I got some compensation off RM for an accident on duty,I slipped on some wet steps and did all the tendons in my ankle.Since then due to this when I get to the end of my walk nowadays since one longer delivery my foot is killing me.It wasn't too bad when we did 2 deliveries.My back injury was also an accident on duty bending down to a letter box.My GP sent me for Physio and I do exercises everyday but now and again my back "goes" every 9 or 12 months and I can't move.Fortunately neither injury have caused me up to present to have much sick leave but I feel with all the s**t their giving us now it won't get any easier and I'm now 52.It just seems that from my original point that some people seem to get medical retirement quite easily and aren't offered indoor work etc.I won't go into details but I remember someone getting it at our office (which is a big Mail Centre and delivery office with Airport work also) who could have done indoor work but got medical retirement and he'd only been there 4 years.The same happened with the last round of VR in that even though there were vacances in Delivery and people younger and more capable than others they got VR instead of filling those vacancies first.It seems if your face fits !

They have to offer you alternative work under DDA.
Although once ATOS get you to see one of their quacks he might as well have a black cap on his head ready to execute you from your job.

I have had to go to ATOS a few times, and even when they finaly give you an appointment, it's often with the wrong person!

The last time I was on sick leave (last year), they wouldn't let me return to my normal duty (on H&S grounds), without being checked out by ATOS. It took about 4 Months, from coming back on Rehab, till I was allowed to do my normal duty!

Because the first 2 appointments were with the wrong people, so they couldn't make a decision.

Having said that. It shows just how long you can stay on Rehab when it suits RM, doesn't it.

IHR is a complicated agreement
the business has to look for a suitable alternative job whether you are dda or not
you need to speak to a rep who is trained and has experience of the ill health retirement
procedures
