Senior management at the XXXX branch have taken it upon themselves to stop sick pay for employees they deem undeserving of it.
Is this something they are allowed to do or is it gross misconduct?
This is extremely concerning as everyone in the depot is now unsure whether they will be entitled to sick pay if they are unfortunate enough to be ill.
Just for clarification, I have not been off sick recently so have not had my pay stopped but am merely here to seek advice on this situation as I was under the impression that sick pay was covered in our terms and conditions and not subject to the whims of management.

No they are not allowed. Why not email the CWU or see your local rep about this?

Sick pay removal.
There are certain and very rare circumstances where they are allowed to stop or not pay sick pay.
1. Triallists within their first year of employment.
2. When the entitlement to sick pay is exhausted - 1/2 pay after 6 months of sick, and only Statutory Sick Pay after 12 months - in any rolling 4 year period and it accumulates.
3. When the OPG has failed to keep in contact. Even then there are certain things they must do. Page 28 of the attendance procedure http://www.cwu-e4.co.uk/Attendance%20pr ... %20etc.pdf" onclick="window.open(this.href);return false;

Sick pay removal.
Everyone gets full sick pay if they provide a doctors note signing them off.
All sickness is to be treated as genuine unless management have evidence proving otherwise, but if you have a doctors note they can do zero themselves

Sick pay removal.
Write to Moya Greene informing her of the office and the manager in charge and any evidence you have. Tell her that this is a breach of employee contract of employment and that your office holds her personally responsible should there be any further cases of witholding sickness benefits unless they conform to the terms under which sickness benefits can be withheld.

I liked the fact that it does specifically state that "the aim of maintaining contact during an absence is to encourage an early return to work where possible"
It means that even when you tell the boss that you are ill and give them a rough idea of when you will probably be feeling better - they will either still expect you to ring up every day and tell them that you are still sick, or more likely they will ring you and bully and harass you into doing a few loops and getting you back into work sooner than expected.

When it says "Keep in contact" that appears to be somewhat vague (not unusual for an agreement between RM and CWU). What is deemed keeping in contact? Every day? Once a week? You are meant to make a plan with the manager on the first day. "I'll ring you on Wednesday if I am not any better". When I go sick I call them every day.
