Unless it is written into your contract that you must notify the company of any overpayment, it cannot be recognised as theft. I would see it as an advance of wages that can be repaid at the request of the business.

I don't know whether you are obliged, contractually to notify overpayment, however, morally you should.Lincox wrote:Unless it is written into your contract that you must notify the company of any overpayment, it cannot be recognised as theft. It is theft if you knowingly keep what is not rightly yours, because you intended to permanently deprive them.
We all know what this company is like, so why give them the chance to oust you. It doesn't affect you giving it back, because it's over what you were expecting.

This does not meet the criteria for theft however any overpayment will be rectified once they find out and they will.rubberbond wrote:I don't know whether you are obliged, contractually to notify overpayment, however, morally you should.Lincox wrote:Unless it is written into your contract that you must notify the company of any overpayment, it cannot be recognised as theft. For those who have suffered non or delayed payment of overtime, is this also not considered as theft on a corporate basis and is it not also a moral as well as a legal requirement that the company pays this in a timely manner based on the contract of emplyment and terms agreed through the company and the cwu.. What is good for the goose is good for the gander.
