annual leave on days not on rota to work?

Post by sardonicus »

Hi can anyone clear something up which I cant get my head around?

My contract - 20hrs over 5 days p/t permanent contract.

I have very recently been asked to cover a 3 day float over 23.5hrs with view to making it permanent (not been asked if I want the extra hours or change of contract though contract not changed as of yet or even discussed for possible change).

I am about to take a weeks annual leave, however, on the week I will be away I am on the rota to work the 3 day float I have been told to cover on a permanent basis.

The week of annual leave was not of my choice but it was how it panned out when the 'holiday' guy constructed the leave sheet for the depot for this year, I just kept it that way as no plans.

The annual leave is on my holiday leave sheet as 5 working days allocated with A/L.

On the rota for the week I will be on this annual leave I am down on the schedule that i would have worked the 3 day float I have been pushed into and the rota has the 3 days marked with A/L. The other days are shaded in grey as non working days.

What I do not understand is when i asked if I would be credited back the shaded non working days to my annual leave allowance I was told no, they still counted as annual leave days.

So, and I may be missing the point completely, happens sometimes lol, the week I am on leave, only 3 days are working days, as per my schedule, yet I am being deducted 5 days from my annual leave allowance? 2 of the days being taken from my annual leave allowance are non working days.

The 'holiday' guy told me it still counted as annual leave from my allowance as the 3 days I am actually off from the duty rota( as working) can only be taken as 3 separate 'annual leave days' if they were booked as such. And as they were not the rest of the week counts as annual leave even though I am not working those days on the rota.

As I was only very recently moved ( not asked) from my usual 5 day 20hr obligation and expected to now fulfill another type of duty of more hours and different start times ( another issue causing me grief as i wasnt asked and dont want it) how could I have booked the 3 days separately, and why am I being made to use my annual leave allocation on days that are non working days?

When I queried it with managers they looked at me like I was mad, which I most prob am to some extent, but I just cant join the dots on this one and wondered if anyone can explain why I am using annual leave up on days I am not down to work?

I hope above makes sense and would be grateful if anyone can put me right, would bevery grateful for any input

cheers, paulpaulpaul

You have a contract of employment that clearly states 20 hours over a 5 day period and that's it written in stone unless you have given your agreement that you have accepted the new terms of the floater duty which will be 3 days covering 23.5 hours in total. You have not given your agreement to the increased hours and obviously the management are not intending to pay you 23,5 hours per week on a/l therefore there is no renewed contract agreement and you politely inform them that you wish to remain on your present contract T&C. Any pressure from management inform your union rep of the circumstances.

in fact get onto the rep asap and let them sort it out rather than let the screws bullshit you some more.

If you are on a 3 day week you would only have 13/14 days annual leave

Annual Leave is actually worked out in hours. It's converted to days because it's easier to work stuff out.

So for a 5 day a week postman on a 20 hour contract you are entitled to 90 hours of annual leave; which is 22.5 days.

However, if you're working 3 days, you're still entitled to the 90 hours; but it works out as about 13.5 days.

Hope that helps.

Another consideration if you changed to a 3 day week you would only be entitled to 5 Bank Holidays not the 8 you currently have .. as it is Pro-Rata.
As has been posted you should be paid for 20 hours as that is your contract & the way A/L is calculated. But I can see your point.
