Hi Guys n Gals,

I lodged my appeal two weeks tomorrow and I haven't been given a appeal date yet should I be concerned?

I came across this in the Conduct code book (I received a serious)

A hearing will
then be arranged and held as soon as possible
and within two weeks (up to serious warning)

Rep is aware of it as is the area Rep along with the Dim, been pestering the local Rep but just say's relax :crazy:

Any thoughts people?

Anyone? just wondering once the 2 weeks elapses - tomorrow, can they refuse the appeal?

Notification of intent to appeal
If an employee wishes to appeal a conduct action or dismissal, they must inform their manager within three working days of having receiving the written confirmation of the outcome. The employee should state the grounds for their appeal in this written notification. Step two: Appeal hearing arranged
Upon receiving the written notification to appeal from the employee, the manager should arrange an appeal hearing. This should be arranged as soon as possible and within two weeks (up to a serious warning) or within four weeks (for major penalties). The appeal manager should confirm in writing the date, time and location of the hearing at least five working days in advance of the hearing. The appeal manager should also forward the employee a copy of the file from the conduct meetings previously held which resulted in the conduct action that the employee is appealing against. Additionally, all employees have the right to be accompanied to the appeal hearing. Their companion may be: • A fellow work colleague normally from the same work location • An official employee of a trade union • A trade union representative For

The above is an extract of the Appeals Procedure from the Conduct code. You will note that you should have received copies of the documents 5 days before the appeal date and your appeal should have been within 2 weeks for a serious warning.
As you have now gone 2 weeks then RM will have breached the appeal procedure and I am sure that your rep will not be slow in informing RM of this fact.

That will be the second balls up then by the management and I use that word lightly :thumbdown

I spoke to the Rep this morning and he said more or less the same thing ie longer it takes the better it is for me. Rep wants an outside appeals Manager to hear it and not the DIM which makes sense to me.

I do think I am looked at as a 'target' now although I may be a little paranoid (but doubt it!)

It CANNOT be taken by the DIM it has to be someone who was not involved in the primary decision making and should have received training on handling appeals.

Yes they have breached the agreement but when do they not? :roll:
The longer they leave it the worst it will look on them, especially if they then go on and dismiss you. Then most tribunals will look on the dismissal as unfair. :no no

Also there must be a clear separation between the manager conducting the investigation, the dismissal and the appeal stage of each case . A manager who takes notes at a investigation meeting should play no part in the subsequent decision making process as the possible perception of bias can undermine the fairness of the decision even if no bias actually exists. :wink:

Got my appeal on Thursday! better late than never :crazy:

What should I expect? it is being held in my DOM'S office by another DOM from the local area! I smell a stitch up coming up :sad:

I will be accompanied by my area Rep.

i got serious 2 year warning in dec for a matter that happened in august put my appeal in the next day and i am still waiting
got a lot of s**t to dish up on my old manager think that's the reason

Probably the reason pal! I don't have any really mainly because he/she has only been here 5 minutes!!

depends on your rep i can sort myself out better than my rep so going for the area rep but he seems as slow

depends on your rep i can sort myself out better than my rep so going for the area rep but he seems as slow

Area Rep is booked in for it but he's a busy man so everyone tells us, maybe one of the reasons it's took so long!

Sorry to hijack but if my stage 2 is Ignored it goes to stage 3 after 5 days correct?
