I am on a 30 hour contract and regularly work more than forty hours a week. Just had a weeks holiday. Isn't there supposed to be some kind of adjustment for the fact that you are always working more than your contracted hours, basically covering a full time duty?

your holiday pay will be on your contracted hours which is 30 irrespective of you regularly working beyond these hours. You are referring to the Agenda for Growth & stability for long tern success agreement 2014 which made reference to contracts should reflect actual hours worked and be reviewed every 6 months with consultation between management and union. Unfortunately yes that is correct. Thank you, interesting that there is little or no progress. The company are definitely resourcing lower hours contracted people in full time roles and not paying the attributable terms and conditions with regard to holiday pay. Actually, a new law was brought in not too long ago which states that, if you are regularly expected to do overtime in order to carry out your duties, your last 12 weeks working hours should be used to calculate your holiday pay. This is in relation to your core 4 annual leave weeks only, not to any extra holidays you may or may not have purchased.

Having directly spoken to Acas with regards to this, you only get paid extra holiday when it is "compulsory overtime".
