If work are considering dismissal stage and your absences through I.B.S have now triggered a formal stage 3 prompt then the interviewing manager would have to before making a decision require full background reports from OH Assist interventions and your GP medical records with your consent. If you are a union member and you have been accompanied by your rep at the previous formal prompt stages then your rep should be in a strong position to argue why consideration of dismissal is not appropriate due to the symptoms caused by your medical condition which could be covered by the Equality Act 2010. It could become a case of IHR rather than a case for dismissal but you need to contact your local or area cwu rep who would have full knowledge of your particular circumstances.gav1988 wrote:can somebody point me in the right direction please .. worked for royal mail for 4 years got told by my doctor 2 years ago i had i.b.s causes me have time off work ( i always supply a sick note if i need to) my doctor has advised me to contact occupational health because work are talking of a dismissal stage .
