DOM refusing to refer to OH Assist.

I'm helping a lad at my work who is recovering from cancer. the problem he is having is the dom refuses to refer him to atos to formulate a plan to ease him back to work, so he is just winging it on a daily basis. what we need to know, is there a number for atos that we can ring so we can bypass the dom.

Is he an Idiot. Sorry of course he is.

You must get the Area Safety Rep on this immediately.

In law, the DOM can do as he wishes, but if this went to an ET Royal Mail would get a kicking as the manager has failed to get professional advice from an in-house specialist, failed to follow Company agreements and he may even fall foul of the Equality Act as by not referring the postie to OH Assist (new name for ATOS) he may be treating him less favorably.

Under the Equality Act the turds are supposed to make reasonable adjustments to help people with Cancer, if your colleague is being denied a proper rehab plan or adjusted duty you can do the fecker for disability discrimination in a tribunal. :nana

This plonker of a DOM is breaching the implied terms of the Contract Of Employment which is a DUTY OF CARE which as TBT has hinted should it go to an ET he will get his ass kicked out the door and tarnish the brand name of Royal Mail which they attempt to hold in high esteem in the process. Would also suggest that the lad's area rep be contacted and a call to the Employee Relations Team at Pond Street, Sheffield would not go amiss. :no no :no no

Express your concerns.

First write to the dom asking as to why he is not & will not refer
The member for an OHS referral what are his reasons for not referring the member as this is direct discrimination and if the member has had the condition for longer than 12 months he should fall within the equality act 2010.
Keep paper trails you will have to follow process and by following RM process you will flush these scumbags out.
Come next month they will have to explain as to why RM should keep them in their job roles.

Please remember that it is our members rehab plan NOT RM's.
By having the correct return to work plan in place otherwise you will end up with a failed rehabilitation plan and no one wants that. The most integral part of any operation is its staff our members so to have a full time staff/members in post is crucial to perform maximum outputs and boost efficiency. By having numb skull Dom's in charge who quite frankly cannot cut the cloth as they are failed postman in themselves. A 28 day face to face with the manager needs to take place. I would also insist on a face to face with the OHS and be persistent on this. If you have no joy write an email to Fiona White head of HR for deliveries. Fiona will be able to intervene and do what's best for our member.

By the sounds of it they are trying to IHR this individual. Do not let this happen. Remember that any IHR that takes place in your offices comes back as full time hours on recruitment ok.
If the individual is terminal you will need to speak with the DSM so as to get the Area delivery rep involved and protect the death in service rather than the IHR as this will be a pultry done of money compared to the death in service benefit.
These people think that they are doing there job and scoring brownie points for their heads. However this is neither conducive or beneficial what is important is effective management with compassion doing what is morally right for our members and RM in general.
A return to work plan can start as low as an hour per day building up over time. Persons who have been off work and who carry out a persphetetic activity will need time to build their stamina back up as well as there fitness. You would not expect Mo Farah to run a marathon without any training and being away from running for ages without training for the race first would you.
This is where RM fall down on,that is why rehabilitation plans need to happen without prejudice
You cannot have persons back to work without one in place either. By the sounds of it the Dom in charge is prolonging our members absence so speak with the Area delivery rep as well as the Area H&S rep.
Keep paper trails on everything. RM hate emails because then we have accountability and they have to work and act. Basically do there jobs properly. Gone are the days of eastenders barrow boys. RM expect managers to be proper managers going forward and not as it is and was!

The refusal to refer to Atos is disability discrimination in its self and should be Grievanced immediately.

Just a quick update on the above situation, i went into the doms office armed with the information that everyone had supplied me with, i don't think i'd finished my first sentence before my dom interrupted me and said he will contact OH assist as soon as poss, so well done everybody and thank you.
