Hey everyone,
I lodged a stage 1 grievance with RM about a number of issues, including holiday pay. I met with a manager (outside our office), who states that I would be contacted with a resolution. That was at the beginning of March. As time has progressed, I have sent a state 2 grievance form in about the situation, then finally a stage 3. I gave the manager the stage 3 form over 3 weeks ago, and have still not heard anything. It's now 6 months since I gave them the stage 1 grievance form, and am at a loss as to what I need to do.
I have just filled out another stage 1 grievance form (Yes, a grievance about another grievance procedure). Is it worth handing that one in, or is there a department somewhere in the country I can call, who are going to take me seriously? I looked at some of the grievance procedure, which stated that all individuals with a grievance would be "treated with dignity and respect". Pull the other one!

In my experience the CWU are useless at this so I suggest giving ACAS a call they'll help you taking it to a tribunal! A few of us are having a go at this too good luck

Regarding your submitted grievances and reading your post you have never been interviewed by various managers with different authority levels at the various stages of grievance even incorporating at the stage 2 the employee relations team at Sheffield. If this is correct then contact the ERT Sheffield and explain that your grievance has not been answered.christiani wrote:Hey everyone,

On the subject of holiday pay which I am assuming is that O/T that you regularly work has not been included after a decision by a UK employment tribunal has ruled that this O/T should be included in holiday pay up to a maximum of 4 weeks. There are several tribunal cases on this matter that ignited this matter Neale v Freightliner, British Airways plc V Williams, Bear Scotland V Fulmar and others. On the original ruling that was endorsed by the ECJ ( European Court of Justice) some employers took the imitative to settle back dated holiday payments before the amount of payments escalated however it seems that RM was not to be one of them. Various employment judges have not all agreed on how this holiday pay will be calculated and how far back claimants can go. The other to be resolved is the implied terms in the Contract of Employment in relation to holiday pay whether O/T is compulsory or voluntarily in relation to the tools of the job. There is also the matter of the interpretation of holiday pay in the Working Time Directive 1998. The 3 months grace for proceeding cases to ET has also been considered. So basically RM is still sitting on the fence before they sanction regular working O/T to be linked to holiday payments.
