meal breaks and overtime.
hi just a quick question just to get the right information ,right your start time is 7.00 - 14.45 and you take 20 mins meal break before leaving the office , and you get back to the office at 14.55 , what do you claim ? thanks for your advise .

Does your office have a local agreement where the outdoor meal relief can be not taken and then accounted for in your finish time, either finishing 20mins early, or added to your finish time in an overtime claim?
If it does and you have not taken your outdoor m/r, then your adjusted finish time is 1515, your o/t claim is 30mins.
If you do not have a local agreement in place, you can only claim 10mins, or take your outdoor 20mins on return to the office and then leave the building at 1515 to then claim your 30mins o/t.

If you are working a 7 hour 45 shift you are entitled to 40 mins MR.
You have taken 20 minutes of this and have finished 10 minutes over, therefore your total claim would be 10 mins extended + 20 mins meal relief for a total of 30 minutes.
Where are you getting 15:15 finishing time from?
The only way that a 15:15 finishing time would apply was if RM could stipulate that you had to have your remaining MR on their premises - which they cannot do. They can however insist that you can only claim up to the time you sign out office, so you would have to take the remainder of MR at whatever location you choose and then return to office to sign out.

Why are you deducting the 20 mins MR that you have indoors from the finishing time? that's why I'm asking the question as he was told he cant claim 40 m/r which is fair enough but can claim the other 20 mins at the end of shift , but if hes only had 20 mins then that is taken off his finish time 14.45 , leaves 14.25 and he finished at the office at 14.55 so hes worked into his other 20 mins m/r , so he claims from 14.25 to 14.55 when he worked to , 30 mins excess so does he still not claim for the 20 mins he hasn't had ? which would take his finish time to 15.15 ?steve1873 wrote:Why are you deducting the 20 mins MR that you have indoors from the finishing time? If your finish time is 14.45 and you work to 14.55 its ten mins o/t.

No. If he has had 20 minutes then he has 20 minutes outstanding. This means that you add 20 mins on to whatever time you finish at - in this case 14:55, so you would claim u til 15:15. But based on the 14:45 finishing time, not some made up fantasy finishing time of 14:25. EDIT: What you are basically doing by adjusting finishing time to 1425 and then claiming an additional 20 mins on at end of 1455 to 1515 is claiming that outstanding 20 minutes twice. So giving you (or the person this refers to) a total MR of 60 minutes, which is obviously fraudulent. You only do 1 or the other. Add the outstanding on to actual finishing time to give you time to claim until OR revise down finishing time to take in to account the outstanding MR which then allows you to calculate OT claim by working back from actual finishing time! Hope this helps and apologise if tone of original reply was a little bit condescending.
