Hi, I have a bit of a complicated situation.
My partner who also works for royal mail had been having trouble with his upstairs neighbours, which resulted in him being arrested on Wednesday night, up at court Thursday. we called and left a voicemail for his line manager (who admitted 'I saw I had a voicemail but never listened to it')
partner was up at court Thursday then released, again phoned and text his line manager as soon as he was released, still no reply. he went into work on Saturday to be told they found out he was up at court and he could resign or be taken through code of conduct for 'dishonesty'. he left work to seek advice from acas.
went into work today to explain the whole situation to be told he has a 'failed trialist meeting tomorrow'
my question is, how can they change it from resign or code of conduct, to failed trialist meeting?
he never got the chance to explain his situation as the line manager never answered or replied to him at all. he only got to se him on Saturday.

You did the right thing by making contact with your partner's line manager and left a voicemail message BEFORE his court appearance and again phoned and texted AFTER his court appearance therefore there is no dishonesty to be answered. Is this line manager who has admitted to the voicemail taking the " failed trialist meeting" and if not would he still be willing to acknowledge receipt of the voicemail. Your partner should be able to produce the text message sent but it would be better if you can produce evidence that contact was made BEFORE the court appearance. Your partner was released on Thursday and returned to work Saturday what happened on Friday? Not knowing the full circumstances of the situation but if violence is involved then RM may be reluctant to employ him but at least you should still be given the opportunity to give a full explanation of what happened. As a triaist he will not at present be a union member but if he can make contact with the union rep to accompany him at the " failed trialist meeting" There is also the possibility that his trialist period can be extended.christinec wrote:Hi, I have a bit of a complicated situation.

yes we can show we called his line manager on the Wednesday. the reason he was arrested was because he 'vandalised there property' .... all that was done was he kicked a few of there garden chucky stones onto the path by accident, which we brushed up straight after. no violence involved but this isn't the first altercation we have had with them.
the line manager said his phone was off on the Thursday from 6pm (my partner tried to phone and text around that time)
Friday my partner was supposed to be in doing overtime , so in his text he sent he asked what time he was to start working at - no reply until 6am Friday morning to say ' we didn't think you were coming in so we covered your shift see you tomorrow. we were supposed to be going away for the weekend and he was due to have Saturday off as a holiday which was also cancelled.
he arrived to work on Saturday and started tying down his mail to be taken into the office by another manager and given those 2 options - resign or code of conduct and his ID badge taken off him.
it is not the same manager he text who is taking the meeting. Although my partner stated he left a voicemail, tried to call and text with no reply. the manager said he would need to look into this.
all seems as if they are just trying to get him out the door, and saying hes a failed trialist seems to be the easy way to do it, rather than code of conduct

As meeting is scheduled for tomorrow try to get a postponement until your partner can get representation.

Just noticed that they have removed is ID badge before the meeting has taken place there prejudicial in the interests of justice. Definitely needs someone with him to argue his case.

his union rep is currently one of his line managers, would that be ok? or better to ask for someone new

phoned the number provided and they cant find him on the system
will this be because hes not a full time perm? he stared in the sorting office in December, the a posty in January.
also if he cant get representation tomorrow or get the meeting postponed and they sack him. is that it done? or do they need to give him notice?

my partner may be confused and think its this guy. I think we might just need to wait and see what happens tomorrow.

Bit confused whose not on the system ? Being on probation has nothing to do with his union representation, you are a fully paid up member from the day you join.
Get back onto HQ and ask for your branch number, they will have his union details and be able to offer advice.

when I called the 0208 number I was given his Glasgow branch number.
I called and gave his name, dob and postcode. lady said she couldn't find any info for him.
