Can a manger send someone home just to allow them to add another duty onto absorption, just because they think the mail is 'quieter than predicted'? (the people getting sent home have leave outstanding but are only told after being in the office for around an hour and as such have completed an hours work.)

legally he must give twice the amount of leave as notice before someone getting annual leave so he must give 2 days notice to give someone 1 day off

Sending someone home who is scheduled to be in and use a leave day? Well dodgy! :arrrghhh

Sending someone home is working a day off, but giving them pay for what they have done? A much better solution, although OPG working day off might be a little aggrieved at being messed about.

4. Booking time off
The general notice period for taking leave is at least twice as long as the amount of leave a worker wants to take (eg 2 days’ notice for 1 day’s leave), unless the contract says something different.

An employer can refuse a leave request but they must give as much notice as the amount of leave requested, eg 2 weeks’ notice if the leave requested was 2 weeks.

Can he force the incumbent to take leave for that day so he can lapse. No

But he can ask, and under no pressure at all the postie can accede to the request.

I for one can't see why you'd take a days leave when you've already got up, driven 3 miles in and worked and hour/hour and a half!!

Taking away wether the postie wants to or not - is the DOM allowed to 'create' lapsing like that?

Same here. They'd be crazy too, but a new starter feeling under pressure probably would which is why experienced staff need to keep an eye out for this and not ignore it.

The DOM is allowed to fill your contracted hours how he likes. Ignoring the leave part, he can release someone to another unit/duty to enable lapsing if he wants. Technically he could lapse every duty in the office if he wanted to, but even the most megalomaniac manager wouldn't.

The joke of it is it's experienced staff that get asked!! Thats what we're dealing with in our office!!
