Quick question, can the Dom take someone off of their night duty and force them to do a delivery over the summer period?

short answer is yes, but reasonable notice should be given and disagreements should be fought if not wanted, also may still need to be paid night allowances depending on the circumstances

Need more info. if possible. Does this " someone" work on a night duty as their signed duty or as a reserve. Does this " someone" work on the night duty to suit their lifestyle eg. takes kids to school during the day or acts as a carer during the day in this case the answer is NO> If a reserve the answer is YES provided a notice of a minimum of 7 days is given for the change.
Being moved from night shift to a delivery involuntarily then their night shift allowance would be retained unless this is the result of a disciplinary process but cannot be applied until the appeal stage has been heard.

There are 5 full time duty holders on nights, the Dom insists he is going to force one of them onto walks over the summer period, he says he can do what he wants even though the area rep has told him you cannot change someone's attendance times.
Now the Dom has asked each person if they would do it, each one has said NO, if he is allowed to do it, should it be the least senior person?

The area rep has already made his feelings known to the DOM. Now it is a matter for your area rep to lodge a 1st stage disagreement for the status quo to remain and take this further through the IR Framework
