Do have to go back to work after paternity leave or can i hand my notice in ?

slightly connected but why are you wanting to hand your notice in?

If as you have new job then if you start the new job before the end of the paternity leave you won't entitled to be paid for it

in that case as you are not starting a new job then you won't need to pay any paternity pay back, next questions then are: is his mother taking her full maternity leave? and how long are you wanting to take off from work in total? and lastly when is the baby due?
