Overtime

Im currently full time postie 6.30-14.30 and looking to do some extra hours in mail centre at 17.00-21.30 does this breach my daily rest period or am i allowed to go????

Yes, a worker is to have a minimum of 11 consecutive hours daily rest in each 24 hour period

Just to note, the law is you have the right to a daily rest period of 11 hours, not that you must take it.

In fact there are circumstances where having less than 11 hours is perfectly legal

You do not have the choice to opt out of the 11hr daily rest. Yes legally there are occasions where there are exceptions to the law (professional drivers for example) but most of these don't apply to your average postie/mail centre worker.

With a lot of staff being part time this makes it difficult sometimes to earn a living unless you are doing overtime immediately before or after your normal shift. This applied to me in the past and I queried it with ACAS but was told that is the law. I asked how people went on that had 2nd jobs eg working in a bar/restaurant in addition to a 9-5 job. I was told that it was the worker's responsibility to make sure they abided by the requirements of the law.

As all of your employment is with RM the person responsible for keying your overtime will be aware that you are working over the legal amount and whilst they may ignore it, if there was ever an accident at work RM could imply tiredness was a major factor as you weren't getting the legally required rest, and it offers them a "get out of jail free" card!

Come in as early as 1:30am instead you'll be within min rest then.
