ATOS/OH assist ruling???

So I've been signed off by my GP, but a colleague has said that the OH assist telephone consultation interview can over rule the GP's sick certificate. Anyone know if this is true, or can shine some light on the subject.

Both your gp and oh assist only provide opinions, your dom doesn't actually need to follow either

its true especially as the "sick note" is now called a "fit note"

I suggest reading up the attendance agreement in downloads - it shows what should happen for different levels of sick absence from a few days to long-term.

Sorry, but Royal Mail can override your sick note as ZX says they are opinions which a stupid or brave manager can ignore. As I suggested if you want to fight the manager if he tries to overrule your GP, or the advice given by OH Assist to your manager is different to the GPs then I strongly suggest reading up on sick absences in the Attendance Agreement. At the very least you'll know more than your manager.

Not had any conflict with manager or along that line, it just OH assist told me to return to work after a week extra off, the very same day I had been signed off for 2 weeks by my gp. Can't find a link for attendance procedure so can't read up on that. If it helps, I was injured in an RTA out of work and haven't returned to work since. So it seems daft that oh assist can deem me fit for work, only by speaking to me on the phone.

Don't get me wrong, I know they have a job to do with rehabilitation back to work, but if I don't feel fit enough to return, it doesn't make sense them trying to force me. If I go back early, and then have to have time off again, they look like fools and my sick record is up the swanny and I'm then on another stage warning. Pointless.
