Breaks

Post by Burghboy »

Came back to office today to find out am part time tomorrow, 8.10 start been filling full time shifts for over a year or so. Break time in our d/o is 8.30 ish 20 mins after the part timers start after we tied up. It's ridiculous 20 minutes into your shift your expected to take your break. Is there any way around this? I will be working wi a full timer who will be on break from 8.30-9.10.

Breaks

So starting at 0810, your contract hours finish by 1310 and you sign out of work by 1310?

If you are still working at 1311, your paid break entitlement increases by 10 minutes to 30 minutes in total. If you are still working at 1511, you get another 10 minutes paid break, etc. etc.

Paid break allowances are not determined by your contract hours, they are determined by how long you work on any given day.

UK employment law:-

Taking breaks

Employers can say when employees take rest breaks during work time as long as:
the break is taken in one go somewhere in the middle of the day (not at the beginning or end)
workers are allowed to spend it away from their desk or workstation (ie away from where they actually work)

It doesn’t count as a rest break if an employer says an employee should go back to work before their break is finished.

Na we don't finish until 2.15 tomorrow so am intitled to 30 mins break. But that's not the issue, the issue is being told to take it 20-30 mins after you start then being out on delivery for 4 1/2 - 5 hours.

Yes but if you work less than six hours a day that doesn't apply as you have no legal entitlement to any break.

and also only applies to the first 20 minutes of your total breaks not the whole amount

Workers are also entitled to "Compensatory Breaks" to make up for breaks not taken at their due time. Or if there has not been a full 11 hours of rest between shifts.
