This is really question for the senior Union guys on here.
Time and time again Managers believe they have medical knowledge and not only ignore ATOS ,blatantly ignore all their recommendations which in my case caused further health problems issues. What is the point of ATOS if the very managers who refer you to them ,then don't like what ATOS says.

Should not the issue be raised with senior management the pressure Area delivery Managers are putting on to their junior Managers who are ignoring Atos reports and causing staff further health issues.

Was the advice the same from your GP and OH Assist or was it differemt - because

The change to the Attendance Agreement has been jointly agreed with the CWU and Unite/CMA.

Once the difference in advice has been reported, the RHL will review the case by speaking to OH. If the case cannot be resolved, with written permission from the employee, the RHL will make contact with the GP.

If it still isn’t resolved, a face to face appointment with an OH physician will be arranged to determine the final outcome. The RHL will confirm this to the appropriate manager, who will inform the employee verbally and in writing.

In cases where the employee has been advised to return to work but does not, the manager should contact HR Advice and Support.
Seeing as the source is official, wouldn't ir be logical that if he was to go against OH Assist advice then he would need to contact the same team first. Might be worth a senior rep commenting on that as well. :hmmmm

Lino referred me to Atos , the ATOS nurse was really concerned about my well being and made 3 main Recommendations regarding my duty ,each one was totally ignored ,with the the lino who referred " saying what sort of job is this " as I was trying to follow ATOS recommendations which the managers totally ignored resulting directly in further Medical issues and severe pain as a result .Surely it cannot be right Managers ignore ATOS recommendations .

They can, but it is a very brave or stupid one that does without good reason.

Unfortunately as far as I know the only way to combat it is to raise a grievance, and if you feel strongly enough to take it to an ET. In any case, I think official contact with the ASR (Area Safety Rep) would be a good start, they could raise the issue with the DSM (Sector Manager) and if that doesn't sort it go down the greviance>>>>> ET route.

It amazes the feck out me this does,you scrotes give it the billy big bollox about sending us to atos,you don't like the answers they give so you ignore it.

I am writing in response to your email on the 15/02/2011. We have considered your request under the terms of the Freedom of Information Act 2000. In your email you requested the following:

“….could you please provide the number of frontline managers in delivery and processing within Royal Mail Letters who have had medical training to a level that they can ascertain the health of an employee and give advice as to what work the employee can safely do within the business group as apposed to a doctors certificate.”

I can confirm that we do not hold information of the description specified in your request. Employee health services are managed by an external provider on behalf of Royal Mail.

I'm sorry that we can not be more helpful but the information you have requested is not held.

When you go in for your little chat with the manager, take in your union rep/friend/recording device and get it all recorded in some way.
When the manager starts his ignorant blustering, merely ask him/her to put his thoughts and reasoning into a formal written request, signed and dated, and you'll pass it onto the relevant people for consideration.
Many managers (especially of the thick low-end OPG variety) believe rules are there to be swerved or broken, and that what they say goes, but then most have just enough feral cunning to realise that the written word can and will come back to take a large chunk from their ar*ses if they over-stepped the mark, and attempting to "force" someone off sick to return to work is over-stepping in a big way.

Ha ha That's a Good One Tman! :dance Have you ever managed to get any Manager to put anything in writing? I never had. You're lucky if they Print off your leave form! I'm sure they're Trained at the Royal Mail BS School that under NO CONDITION should they write anything down! :hmmmm Mind you if you E-Mail them you can print off their reply, which I've found useful in the past. :thumbup

We had a manager who had a remarkably large opinion of the Official Secrets Act covers. I was almost hoping they would call me into the office for mentioning on Facebook that I worked for the Royal Mail (not that I'd be friends with a manager on Facebook, but it's always possible that one of your "friends" might turn to be!), at which point I had my first two questions lined up in advance.

[1] Which section of the Official Secrets Act 1989, as amended, applies to this situation? (I had it bookmarked on my smartphone, so if they gave a clause number I was going to read it out!)
[2] Since breaching the Official Secrets is pretty much a definition of treason, and since you haven't called the police doesn't that mean you're guilty of something akin to Misprision of Treason?
