Overtime query

Post by makingsounds »

A colleague who was on annual leave last week performed overtime yesterday (Sunday deliveries), came back to work today to be told he was still on leave this week as well. He said he had performed O/T yesterday thinking he was back to work today, the manager has told him he can't and won't get paid for yesterday. Clarification needed on this or any agreement which covers it off please.

tell him to speak to the rep asap, does he work sunday as part of his normal contracted week?

if so then he was on annual leave and working it though not illegal in anyway as long as it's voluntary is against the way forward agreement.

If he say works monday to saturday with a rotating day off and Sunday is his second day off, then in this circumstance he was not on annual leave on the Sunday, your only on annual leave on the days your contracted to work. Sunday is thus his day off and if he worked it he has not broken any agreements

regardless as long as the manager authorised him to come in then he must be paid, if not then rep should help him lodge a grievance

If you are told/asked to come in to work, which I presume he/she was, you must be paid for it whether it's in the middle of your annual leave or not.
