Breaks at start of duty

Out DOM has advised us from next week that part timers break will commence 35 minutes after starting and is to be taken in full. Basically we are expected to to come in at 8:30, tie down and load the van for 9:05 and then take our 30 min break until 9:35. I'm sure I read something on here ages ago stating that breaks were not to be taken just after starting the shift and don't need to be taken in one go i.e i could take 15 in the morning and 15 halfway through if i choose. Can't seem to find anything though that mentions breaks. Any ideas?

What he is trying to do is legal, break after 35 minutes after start of shift is not a break at start of shift from a legal stand point

if you are not happy with the change ask your rep to put a stage 1 disagreement in about it

Not sure though it fits in with the spirit of "somehwere in the middle" for statutory breaks. :hmmmm

may not fit with spirit but does with letter of the law and unfortunately that's what counts

We have part time coming in at 830 with a break at 910

What about the national agreement of being allowed to take some break off the finish time, if not used?

I think DOM can force OP to take 20mins, satisfying the employment law of a 20min break if working 6 hours or more, but the OP could finish 10mins earlier than their contract finish if they choose not to use the other 10mins break on delivery.

Law relies on probability and precedent

Just after starting would get shot down in tribunal,

But with the new fees and the job market, who amongst the workforce will bring that to a court.

That's what the Dom knows and is relying on,fatigue isn't cured by a break at what is essentially the start.

The accidents will pile up untill they hit an unacceptable financial level.

But its always been that way and won't change anytime soon.

Isn't, or wasn't there something that stated you must have at least 20 mins after 4 hours work?

Depends whther you mean statutory on contractural.

Statutory breaks are a minimum of 20 minutes if expected to work 6 hours or more and it can be unapid.

Royal Mail breaks are based on attendance length. The longer you work, the more PAID breaks (except Angard) you get.

Thanks zx135,shows a complete disregard for the welfare of the P/T workforce,this is one of the reason's I don't put myself out too much for this company,I have no hesitation in doing a fair days work for a fair days wage,but when they try and lay the guilt trip on me for not bending over backwards to help them out I think of thing's like this.
