Advertising vacant duties

Can they advertise a Full Time Duty saying only Fulltimers may apply because they already have enough Fulltimers, ie they are not prepared to make anyone up? TIA

simple answer is no. The way forward agreement specifies how a vacancy should be filled and it is the most senior person who gets it regardless of whether pt or ft, so if dom is trying this on get your rep to lodge a disagreement about it asap

Thanks. I'm actually the rep, but I'm quite inexperienced. He has said this is the way he wants to advertise it, but I had a feeling it wouldn't be right. It's academic anyway, because of seniority, but if he tries to add that proviso onto it, I thought it might be illegal anyway.

It's not really academic due to seniority, as if a ft staff member gets the vacancy their duty then becomes vacant and needs filled and so on, so there may be a lot of shuffling as that jumps down the line but at the end of it there should be a ft vacancy available for a pt member of staff who wants it

I understand that, but in this particular instance, while I'm trying to get them to "see things my way", that's the argument I may use for now to avoid a childish backlash. I'll check out the correct procedure in the agreement, anyway, I just thought I'd seek advice from experienced heads while it's on my mind on a Sunday morning.

They have done the same in my office... But, they were not even explicit about the fact with the advert that you only have to be at that particular contract to apply for a job.

It is interesting because they do not want to make people up but the vacancy is still going to be there if there are no takers from the full time pool. However, the office might quite a few full time reserves and they could easily cover the duties minus 1 full time reserves?

You will get the typical response that it should not happen and that you can raise a disagreement - pish! There is a lot of things happening that never used to happen - and they continue to happen regardless of protests...

thee things are happening exactly because no one is following the correct procedures and raising a disagreement, if they just carry a ft vacancy instead of filling it they can do that but only for 6 months then it must be filled, or alternatively if the vacancy level goes above 5 percent it should be filled immediately

You should be thankful they are advertising for the vacant duty and not just seeing it as another walk to lapse. That's what they do at our place.
