Well its that time of year again where the football season begins so the selling of walks has begun already in my office because of operational needs ticket holders cannot get Saturdays off.

Question If someone sells a walk to a guy who is off that day and its agreed with the DOM what happens if the guy has a accident on duty, I mean is he covered because legally he is doing it money in the hand tax free? If it went legal I would say R M would go down the route "You shouldn't have been on that walk" By the way the going rate is £65 in our office.

Yes they are covered for 3 reasons:

Vicarious Liability Insurance.

They have got permission from a Manager, also hopefully they have filled out the swap register.

Its an agreed process under the flexbility agreement:

This flexibility could also facilitate arrangements for employees to make their own arrangements to cover and swap duties (subject to approval from their manager) – within contracted hours, providing quality of service is not adversely affected and there are no additional costs to the business.

However, one small point, apparently its illegal to pay others for work you should be doing, something to do with Tax Declaration (guess). However I can't find anything to either confirm or deny this hopefully a passing employment wizard will point us in the right direction.

This practice is known legally as 'caddying'.

They never fill out a swap register! One guy paid another few months ago he never turned up on the day the walk holder was unreachable it went down sick on his behalf something he didn't want.
