Colleague in Exeter was summarily dismissed on Monday for leaving his van in the yard with the passenger’s seatbelt plugged into the driver’s seat belt holder,at no time was he seen driving without a seatbelt.He has denied driving the van without a sealtbelt.

Regardless of is it fair is it this is it that,(His branch is looking into it ect)this is Royal Mail!

The problem is with employment tribunals is the level of proof required is not very high, all that is needed is a reasonable expectation that it happened, there is no burden of proving beyond reasonable doubt, so unfortunately a van with the seat belt plugged in like that is all that is needed they don't need to prove he actually drove it like that just to say it is a reasonable assumption

Union Rep did this today seeing as he used my duty van and he was the last name in the log book he's basically a Management anyway so it wouldn't matter

Legally yes it covers us as long as not travelling more than 50m however it's against rm policy so the fact it covers us is really irrelevant and as you may not get 3 points from the police but get the sack instead from rm

The original post isn't so informative as to gauge whether the person is guilty of any offence, he may well be, he might not. But one things for certain its managements call not ours, and its the Unions responsibility to fight for his corner.

If they are guilty of committing the same act and subsequently caught by the police I would agree with your statement, but not when its an employment matter.

Unless offices around the country are inspecting vans for this kind of behaviour why is it acceptable for one individual to be singled out?

I wager there are easily 100+ RM vans with belts plugged in to the drivers side sat across yards throughout the country.

Do you know how many dead and seriously injured people we have on out roads each year? 22 THOUSAND.
