Permanent change of duty content.
Hi guys. Wonder if anyone on here can help. Been working lates Mon to Fri for the last 16 years. They now want us to work Saturdays and give us a day off during the week. How much notice do they have to give us? I think its 28 days in writing. Any help would be appreciated.

This is only my opinion, so you`d need to check it out but this appears to constitute a major change so a repick should take place. You should get your rep/area rep involved. This can be stalled by putting in a disagreement & the possibility of a full repick may make your DOM rethink his proposal. Good luck.

Strictly speaking it shouldn't be happening at all without agreement, the 28 days notice period is designed to allow the IR framework to be exhausted but since you make no mention of any ongoing negotiations it would appear that these changes are being applied using executive action which is something the business has committed to avoid in the last agreement.
If that's the case it might be time to give the union a nudge, perhaps bring in the mediators, if it's part of an agreed change then I would expect you would have already had some kind of notice.

nb just to clarify I don't mean a contractual change as most of our contracts are for 39 hours 7 days a week and usually for past 20 odd years don't state attendance days

Welcome to the real world my friend, just be thankful you had 16 years without working a Saturday.
To reply to the point you made, I think you have rights but am afraid the business will play the transformation card. Whether you are entitled to a re pick or not depends on the number of staff involved in the change, generally 50 per cent will give the option for the staff to vote on a re pick.
It would be fair for you to ask for 6 weeks notice, as this gives you ample time to plan your future days off, especially if they are rotating days

Thanks for the replies. Just to clarify a few things. Been fighting this for over 2 years now, was taken to formal disagreement by local rep but management have been determined to make us work Saturdays. We drive 7.5 ton vehicles out of a delivery office and rotate over a 7 week period, they now want us to work on 2 of these Saturdays, would not mind to much but one of the Saturdays does not even include any driving content!

Any thought on this would be great, 2 people have took evr and their jobs are going to be chopped up and attached to the remaining duties as designated flex. Is this going to be classed as a major change, and mean a repick could be triggered.
