Post by robert37uk »

hi there i have a question regarding this and wonder if anyone knows the answer.
every second Saturday i do scheduled attendance and get paid 7 hrs overtime, when im off on holiday and its my weekend to do this i still get paid for it.
im off on holiday now and should have been working this saturday on scheduled attendance my manager has asked me to come in on saturday to work and has told me that i will get paid again for this, does this mean as i get paid already the 7 hrs as im on holiday if i go in will i get paid the 7 hrs again anyone know please.

I don't think you can legally work whilst on annual leave (but you can work rest days) so you would have to cancel your Saturday off and take it another time. Can't see your manager paying you what equates to double-time unless they are really desperate

There is no law that says you cannot work on annual leave days.

But The Way Forward says you can't do it.

Its not illegal for the worker, but if its statutory leave then it is illegal for the employer. You must be allowed to take statutory leave and if you work it even with their consent you patently haven't taken it. If they pay you holiday pay and overtime then that really means they won't give you your statutory leave at a later date and thats illegal. If they don't pay you double then why work it anyway.

Got to ask why didn't you point the original poster in the right direction? You are a rep are you not?

And yes illegal is probably the wrong term

you should get paidfor it whether you're there or not. It is a set up i'm not used to (every other saturday) however pay slips will show you get this money alternate weeks so if you go in and do it you are working for free.
Confused... You won't be, after the next episode of. SOAP
